Catching up on mandatory continuing ed.

These seminars are laughable. According to the speaker, lawyers should not communicate with folks who are on yahoo, Gmail, AOL, or other similar platforms.

Really? I would suggest most of the people I communicate with, including lawyers, use a large service.

The speaker felt that private servers were more secure. I would think just the opposite. But even if that were correct, reality dictates that you use the emails that the world uses.

These CLE seminars are worse than useless.

We moved the office in February. Finally got all the new cubicles in place. (Thanks COVID shipping woes). Hopefully, we can get back on track shortly.

But our new space at 2777 Summer St was so worth the move.

Monday morning I will be in the Appellate Court - again. This time I am arguing against the Court sealing the transactional documents in a tranactional case.

Not exactly sure how we got here in the first place, but off to Court.

We are very gratified that the Connecticut Supreme Court upheld our appeal in Gould v Stamford, reversing the Workers' Compensation Review Board and the trial Commissioner.

We submit the decision will have consequences for many self employed individuals - not just those with single member LLCs. This is a good decision across the board.

You can read the opinion here:

In our latest foray into the Pro Bono side of the Federal Courts, I was assigned a Social Security Appeal. No big deal you say? Well, this was the THIRD time it had been appealed. The record on appeal was two boxes. Just reading the stuff took days.

Thankfully, the Court read my stuff. Even more thankfully, my briefs must have been pretty good. The Court upheld the appeal and reversed the orders of the Social Security Commission. After almost 9 years of litigation, it appears my client will be awarded Social Security benefits.

Of course, the Commission might appeal, but we will have the stronger hand in the Second Circuit. Perhaps the government will be tired of litigating this as well.

We made the paper again. Now the hard work starts.

We made the paper again. Now the hard work starts.

Standard Petroleum was dealt a legal blow by the Connecticut Supreme Court this week which upheld a lower court ruling allowing class certification in a lawsuit alleging the company overcharged customers.

08/22/2018

The Supreme Court of Connecticut affirmed a Superior Court decision which certified a class action against Standard Oil. My clients allege that Standard Oil illegally overcharged all of their customers for Federal Gas Tax and Connecticut Gross Receipts Tax. My clients and all other Standard customers are one step closer to receiving compensation.

There is a long fight still to go.

Well my SCOTUS case made it into the NY Times.

Well my SCOTUS case made it into the NY Times.

In recent years, the court has curtailed the public’s power to hold law enforcement accountable for misconduct. Advocates want the court to rethink its decisions.

Twenty six Amici filed in support of my SCOTUS petition for Certiorari.

I think we just guaranteed that the Court will at least read my application. Whether it is granted.....?

06/15/2018

The Supreme Court (SCOTUS) demanded that the State of CT respond to my Petition for Certiorari. In practice, that means at least one Justice is considering voting to grant Cert.

The DC folks took notice. I have been contacted (directly or indirectly) by about five parties who want to file amicus briefs. It is getting more interesting by the day....
