The Brandon Nutter Team scored an important victory at the Virginia Senate yesterday! The Bill I drafted to amend the Virginia Workers' Compensation Act was approved by the Senate Commerce and Labor Committee after Senator McPike and I presented testimony on the reasons why the Bill should be enacted! The amendment to the Act will allow workers to sue if their employer engages in wilful misconduct or is grossly negligent. The goal is to motivate employers to maintain a safe workplace. Brandon Nutter was killed at work when his employer wilfully failed to follow safety rules mandated by law. We also filed a $20 million lawsuit against the Spotsylvania County employees who were to blame. No trial date has been set.

HUNG CAO UNELECTABLE
Among U.S. Senate candidates seeking election on June 18, Hung Cao stands out as unelectable due to the election fraud controversy surrounding him and his questionable honesty.

U.S.A. Today reporter Elizabeth Beyer broke the story that in 2023 Hung Cao created a super PAC, entitled Unleash America, to raise money in support of state candidates with the objective of ensuring the House of Delegates would remain, and the state Senate would become, Republican.

And then, nothing. Cao’s PAC never paid a single cent in support of any state candidate. Rather, as he was preparing to announce his candidacy for the U.S. Senate, Cao dipped into the Unleash America treasury and took out nearly all the revenue, not for any state candidate but for himself: paying the campaign manager for his Senate run; paying for lists of names to solicit from in his Senate run; and paying for his own Senate campaign political consultants.

Then when caught by journalist Elizabeth Beyer, rather than admit error and pay the money back to those who were bilked, Cao doubled down condemning the Staunton News Leader as a “Podunk paper” and referred to Staunton as “podunksville.”

And then a complaint was filed against Cao with the FEC by an attorney in Stuart, Virginia, on behalf of a client. The complaint asks Cao to be investigated under the FEC’s rules and to be referred to the Department of Justice for investigation for mail fraud and wire fraud. In other words, Cao is going to have a federal complaint hanging over his head if he is the Republican nominee.

But there is more. Cao says he is a Harvard Fellow and an MIT Fellow. Cao flunked out of the Naval Academy and was readmitted despite failing. At best, Cao’s claim to be a fellow rests on the fact that he attended executive training programs offered to officers at Harvard and MIT by the Navy as part of those universities “fellowship” with the Navy.

Cao has that combination of ignorance, arrogance and lack of trustworthiness that is disastrous. Republican success in the Fall will depend in large measure on whether Republicans come to know the real Cao and, based on that knowledge, avoid the mistake of making him their standard bearer.

In his press conference tonight, US Senate candidate Jonathan Emord announced that we have been retained by President Donald Trump’s MAGA Caucus to prepare and file a legal brief asking the NY Appellate Court to overturn President Trump’s criminal convictions.

Jonathan and I will begin work on the brief after our meeting with President Trump and his staff tomorrow at the Trump Resort in Loudoun County, Virginia.

Jonathan Emord is a constitutional lawyer, author, lecturer, and distinguished scholar, and I am honored to cocounsel this legal brief with him.

In accepting this case, I am reminded that the US Constitution guarantees each person, no matter his or her race, religion or political views, the right to due process of law. The right to appeal is one of those due process rights.

FILE $23,000,000 WRONGFUL DEATH LAWSUIT

On May 5, 2024, the law firm of Emroch & Kilduff and Charles B. Roberts, attorneys for the Estate of Brandon Nutter, filed a $23,000,000 lawsuit against four Spotsylvania County employees who allegedly caused the death of 28-year-old Brandon Nutter. Brandon was employed as a heavy equipment mechanic at the Spotsylvania County Chancellor Center when he was killed while working in the rear access area of a compactor.

Brandon, who had a degree in automotive technology and absolutely no experience or training in repairing compactors, was illegally tasked to work on an industrial compactor and sent to his death on his 12th day of employment.

The suit follows the Estate's attempt to settle the case without resorting to litigation, but Spotsylvania County and the Defendants have not accepted responsibility or responded in any way to the Estate’s settlement offer. The wrongful death lawsuit seeks $20,000,000 in compensatory damages and $3,000,000 in punitive damages.
