5 Things to Expect During Your Deposition as a Plaintiff
1️⃣ Your attorney will prepare you beforehand.
You won’t be walking in blind. Before your deposition, your attorney will meet with you to go over the process, answer your questions, and help calm any nerves.
2️⃣ Honesty is the best policy. Keep your answers truthful and concise.
The defense attorney’s job is to ask questions and test your case. Sometimes questions may be phrased in a way that feels confusing or leading. Listen carefully, answer only the question being asked, and don’t volunteer extra information. If you don’t know, say you don’t know. If you don’t remember, say you don’t remember. That’s okay and better than guessing.
3️⃣Dress comfortably, but appropriately.
A deposition isn’t court, so there’s no need to show up in a suit if that’s not who you are. Wear something comfortable and presentable. Just keep in mind that portions of your deposition could potentially be shown to a jury later.
4️⃣You can take breaks.
Many people are surprised by this one. If you need to use the restroom, get a drink of water, collect your thoughts, or simply take a moment, you can ask for a break. Depositions can be stressful, and it’s completely reasonable to take one when needed.
5️⃣Your attorney is there to protect you.
Your job is to tell the truth. Your attorney’s job is to protect your rights throughout the process. If a question is improper, your attorney can object. If something needs clarification, your attorney can address it. Focus on answering truthfully and let your attorney handle any of the legal issues.
⭐️Bonus: One of the most powerful answers you can give is, “I don’t remember.” If that’s the truth, that’s the answer. Guessing helps no one.
