One of the benefits I believe people miss out on most often after a work injury in Missouri is TPD. Especially when they don’t have an experienced attorney looking out for their best interest.

What is TPD?

It’s a supplemental benefit you may be able receive after you’ve gone back to work, but are on restrictions that limit how much you are able to earn.

For instance, if you worked 10 hour days before you got hurt, but now you’re on restrictions that limit you to working no more than 6 hours a day, you are entitled to TPD. If you’re on a “sedentary work only” restriction and work accommodated that but is paying you $4/hr less than what you usually make. You are owed TPD.

In other words, if you are earning less money than you were before because of restrictions related to your injury, there’s a good chance TPD is owed!

People often ask whether they need to get an attorney after they have been hurt on the job. In Missouri and Illinois, you are not required to obtain legal counsel. You know who is required to do so? Your employer.

There is a team of people, including your employer, the insurance adjuster and their attorney, working to minimize the cost of your claim and get you back to work as quickly as possible. They have a team of people that understand work comp laws and how to best achieve their only goal - saving money by getting you back to work.

So while you are not required to hire counsel, you may want someone on your own team who keeps your best interest at the forefront.

Remember - the system wasn’t designed to work for you. That doesn’t mean you have to navigate it alone.

Did you know there is a difference between filing a claim with the insurance company and filing a claim with the court?

Reporting your injury to your employer opens an insurance claim, but to preserve your claim in court, you must also file the appropriate legal documents in your jurisdiction! Failure to do so could result in your case be barred by the statute of limitations - meaning the insurance company no longer has to pay you anything or provide you with medical care.
