In federal court, a “win” doesn’t always look the way people expect.

Recently, partner Talmage Newton secured Deferred Prosecution Agreements in two separate federal cases — one involving allegations of money laundering and the other involving allegations of white collar fraud.

A deferred prosecution agreement is rare. It allows the government to pause a case and place a client on a period of supervision. If successfully completed, the charges are dismissed.

In a system where federal convictions are the norm — not the exception — outcomes like this require early strategy, credibility with prosecutors, buy-in from the judges, and creative problem-solving.

Federal Gun Case — Voluntarily Dismissed!

After a thorough investigation and detailed presentation of the defense, the prosecution agreed they could not prove guilt beyond a reasonable doubt. The result: a rare voluntary dismissal of a federal fi****ms case.

Federal criminal cases are not dismissed lightly. This outcome required digging into the facts, challenging assumptions, and forcing the government to confront weaknesses in its proof—before a jury ever had to.

Partner Talmage Newton has partnered with the National Rifle Association – Institute for Legislative Action in petitioning the United States Supreme Court to review a critical Second Amendment question:

Does the Second Amendment protect the right to possess unregistered short-barreled rifles that are in common use for lawful purposes?

This case raises significant constitutional issues under the Second Amendment and the National Fi****ms Act of 1934 and has broad national implications.
