Let’s not pretend. This offer isn’t a favor and probably doesn’t help you. Your resignation likely benefits your employer more than you.

• Employees who resign voluntarily are generally ineligible for unemployment benefits, whereas those terminated without misconduct may qualify.
• A resignation may weaken potential claims for wrongful termination, discrimination, or retaliation because the employer can argue the employee left voluntarily.
• Terminated employees may have more leverage to negotiate severance pay, whereas resigning employees have diminished leverage.
• While resignation may avoid the stigma of termination, it can also raise questions about why the employee left, especially if they cannot provide a strong explanation.

Ring in the New Year with a raise! Following the approval of Proposition A by voters on November 5, 2024, effective January 1, 2025, the state minimum wage increased from $12.30 to $13.75 per hour, with a further rise to $15.00 per hour scheduled for January 1, 2026. Additionally, starting May 1, 2025, employers must provide paid sick leave, accruing at a rate of one hour for every 30 hours worked. Employees can use this leave for personal or family health needs, among other specified reasons. These changes aim to enhance worker compensation and benefits across Missouri.

Non-compete provisions, which cover almost one in five workers (including low wage workers) across the U.S., have come under increasing scrutiny in recent years, with multiple states banning them for low wage workers and the FTC considering a proposed Rule that would do the same on the federal level. Studies show that non-compete agreements decrease wages and limit employee mobility. On Tuesday, the NLRB General Counsel announced that non-compete provisions frequently violate federal labor laws.
NLRB explained that in some cases, noncompete agreements could be lawful if the provisions clearly restrict only individuals’ managerial or ownership interests in a competing business, or true independent-contractor relationships.
