I believe in supporting small business and voicing my appreciation for those that make my life easier. One big help is Patriot Payment Systems and James Carner for always making my credit card processing simple and easy. In the 6 years I’ve been doing business with James, customer service is just a phone call away. And when my assistant or I call, we get James Carner himself! He always has a solution, never passing the buck. It’s not like the bank I used before, when customer service was a random person at a help desk. Plus I’ve saved $$ on credit card fees.

Alimony: If you pay it or receive it you probably heard about the new alimony reform laws as of July 1. The ink wasn't dry on the governor's signature before I started getting asked about what it means for payors and recipients of alimony. Some people ask whether they can stop paying their alimony now, and the answer is not yet! The concept of permanent alimony is out, and is replaced by a percentage based on the length of the marriage. Over 20 years, you can pay up to 75% the length of the marriage, over 10 years, you can pay up to 60% of that time, and in those rare cases where there is alimony in short marriages of 3-10 years, alimony cannot exceed 50% of the length of marriage. So say a couple divorces after 28 years of marriage, there could be up to 21 years of alimony. However the court can still extend it if it finds it to be necessary. This is not retroactively applied, but it will be interesting to see what the courts will do when considering future modifications of alimony. Need some direction about parenting timesharing in light of COVID-19? Courts in our area recently issued direction to help guide parents during the "shelter in place" order.
According to the recent standing order for this area, since there is a shelter in place order, the parents are to discuss where the children are in the best position to meet the requirements of their school, remain with siblings if possible and be safe. If the parties can’t agree, the party with majority timesharing shall keep the children until the shelter in place order is lifted. If necessary, the court can order make-up timesharing once the emergency orders are lifted and things return to normal.

QUESTION: How old does a child have to be to decide whether to live with mom or dad in a divorce case?
ANSWER: I hear this question a lot from clients who are dealing with a divorce including parenting time issues. Of course, children don't make the decisions, the parents and judge do. But a child may be able to have input as to his/her preference. A judge may talk to a child to find out about the situations at both homes, including their relationship with the parent and with any other person in the home (like new boyfriend/girlfriend). If there are allegations about the conditions in the home, the judge will ask about that too. This child interview will not be in open court in front of the parents. The judges I've seen talk to the child do so in their private chambers, with another person present (such as the judicial assistant). There is no specific age for the child to be allowed to speak to the judge, and the statute states the court can consider the reasonable preference of the child who is of sufficient intelligence, understanding and experience. In real world terms, that usually means teens.

How much does a divorce cost? We often have potential clients who ask for a quick quote over the phone, but the answer is more in-depth than that. Here's the reason: The issues to be handled in your divorce are the main factor to determine the price. For instance, a divorcing couple who generally agree on how they want to divide things can do an uncontested dissolution of marriage. I make sure my client's legal interests are protected, and that my client understands the terms of the agreement, draw up the documents and settlement agreement, and file the case with the court. This is the least expensive alternative, but most cases are not that straightforward. When the parties don't agree on how to settle, the case is contested, and the fee depends on what issues there are to resolve. For a client with children, that includes parenting time, child support, and division of parental responsibility. It also influences the work to be done (thus the fee) if the client (or spouse) owns real estate, has a business, or has investments. A contested case can involve multiple court hearings, mediations, and preparation of motions and other documents. The more complex the issues, the more work required. What I hear again and again at the end of a consultation is, "I feel so much better, now that I understand what to expect and know what my rights are."

Question: I want to file for divorce. If I leave the home that my spouse and I jointly own, will that mean I abandon my financial interest in the house?
Answer: No, you would not be giving up the right to your share of the house value. If you want to leave, you may do so, and you'll still be able to claim your part of the home's equity. However if you have children, the issue of leaving the home is more complex. There are parenting time issues to be considered, and you should ask a lawyer the best course of action.

QUESTION: When an unmarried couple have a baby together, what rights do the dad have? Can the mom make unilateral decisions about the child?
ANSWER: The unmarried mom is the natural guardian and sole custodian of the child. She can make all decisions. Unless and until a judge has made a finding of paternity, the dad's parental rights are extremely limited.
