The Washington Supreme Court held in Estate of Essex v. Grant County that a hospital is liable for the negligence of a doctor who was an independent contractor. This is great news for patient advocates. Hospitals, especially emergency rooms, utilize independent doctors to treat patients. The Washington Supreme Court wrote that hospitals remain responsible for the acts of independent contractors because Washington statutes and regulations impose nondelegable duties on hospitals.
