Step 1: Calling 911 is appropriate. Many, if not most deaths, occur after someone has reached an age that death seemed likely and requires little or no investigation. The police are trained to make this determination for you. In many deaths, there is a contributing factor other than old age. Life is...

All of Estate Planning boils down to (1) recording what you want to happen to your property when you pass on and (2) taking care to meet all the requirements of state law to distribute that plan successfully. Many will tell you they have the answers, and some really believe they do, when they have [...

Here's a tip on Wills and Trusts:

Shortcuts rarely turn out as intended. One popular shortcut is to add a child as a joint tenant on the deed to your home. This has two significant flaws:

Flaw 1- Your child now owns part of your home, so you need their permission to sell, and your child's creditors can force the sale of your home to collect your child's 50% share.

Flaw 2- If you had used a Will or Trust to pass on your home AFTER your death (instead of the deed shortcut) you would have allowed your children to skip all of the capital gains taxes that have accrued on the home since the date you purchased it.

What is a Trust? Do I need one?

Most people have heard of a Will because it is so commonly portrayed in books and movies. All of the heirs are shown sitting with rapt attention while an attorney reads the Will and describes who will rewarded by the decedent. A Will normally states the decedent’s last wishes. Property is distribu...

WHEN IS IT TOO LATE TO SIGN A WILL OR TRUST?

It goes without saying that you must take all steps necessary to complete a Will or Trust before you have died. Anything produced after that date cannot be recognized as valid wishes of the decedent. Anything produced while in a coma will have the same result. Though such questions seem ridiculous,....

The short answer, almost always, is: NO, please don’t! But there are exceptions.

As an attorney and a licensed Title Officer, I have seen many parents attempt an early deed transfer to avoid attorney fees, probate, medical liens and taxes. Unfortunat...
