Many members of our team work from home or otherwise work out of the office several days a week. We use e-mail and the morning call to keep the team aligned and cases moving toward conclusion. We regularly measure client satisfaction using the NetPromoter system. We ask our clients the key question: “How likely are you to refer us to a friend or colleague?” More than 80% of our clients have said they would recommend us to their friends and colleagues. We believe that employee retention and engagement are the key drivers to our consistently high client satisfaction scores. With the exception of one employee, all of our attorneys and staff have worked with us more than 7 years. We regularly engage our employees in candid career discussions focusing on core retention questions originally outlined in First Break All the Rules, by Marcus Buckingham. In our most recent employee satisfaction report administered by Gallop, we scored 84% in overall employee engagement. All employees receive an anniversary bonus that grows every year and are eligible for quarterly bonuses. Over the last 10 years, Scott & Scott, LLP has grown into a successful national boutique law firm. With that growth, we are fortunate to have the ability give back to our community. We match our employee’s charitable donations 300% and the firm’s Charitable Trust works to support employee and client selected charities.

A Lawyer’s Joke

A tech business owner walked into a lawyer’s office, already bracing himself for what was coming. He had been through this routine before—trying to explain his business to a lawyer who barely understood the difference between a server and a sandwich.

As he took a seat across from the lawyer, he got straight to the point.

“I need help with my customer contracts. We offer IT managed services, cloud and hosting, backup and disaster recovery, managed compliance, managed AI, and managed voice solutions on monthly recurring contracts. We also need to ensure compliance with all state, federal, and international data privacy laws.”

The lawyer looked up and grinned. “You’ve come to the right place. I currently represent 650 managed service providers just like you.”

The business owner raised an eyebrow. “You do?”

“Absolutely,” the lawyer said. “And I’ll tell you what—give me ONE DOLLAR, and I’ll implement a whole new contracting platform for you. Industry-leading templates, fully customized for your business, dynamically updated to stay compliant as the industry evolves.”

The business owner leaned in, intrigued but skeptical.

The lawyer continued, his confidence growing. “In fact, if you onboard within 30 DAYS, I’ll give you $500 CASH to get things moving. Your FIRST PAYMENT isn’t due until day 60. And if you’re not happy by day 90, you can walk away—no strings attached. But if you stay, it’s just $500 PER MONTH for 36 MONTHS, and I’ll proactively keep your contracts up to date for you.”

The business owner blinked. He stared at the lawyer, then glanced around the office, half-expecting cameras to pop out from behind the law books.

“This is a joke, right?”

The lawyer leaned back in his chair and smiled.

“No,” he said. “It’s called MONJUR.”

One of my favorite parts of working with digital marketing agency founders is hearing their journey—the wins, the challenges, and the late-night worries that come with scaling a business. Today, I had an insightful conversation with a founder who was reworking their terms and conditions, aiming for better compliance and risk management while integrating contracts into their CRM.

What I’ve Learned from These Conversations:

Digital agencies are scaling fast, but their legal infrastructure often lags behind. Terms and conditions get written once, forgotten, and eventually become outdated. Keeping them dynamic is key.

Most founders want simplicity. The idea of reviewing legal agreements with every client renewal is overwhelming. Automating updates and using "browser wrap" agreements (like how SaaS giants do) can eliminate friction while keeping protections in place.

Risk comes in unexpected forms. Whether it’s a partner dispute, a compliance shift, or a third-party vendor failure, digital agencies need to structure liability limits, vendor agreements, and insurance to mitigate exposure.

AI and automation are changing the game. Agencies are integrating AI into their workflows, and that means contracts must evolve too. What happens when an AI-driven campaign misfires? Who’s liable for ad spend overruns? These are the kinds of questions that keep agency owners up at night.

At the end of the day, my job isn’t just about providing legal solutions—it’s about giving founders peace of mind.

At the IT Nation Evolve Peer Groups in Houston this week. During lunch, I presented to a group of CEOs from PE-owned or backed IT Managed Services firms. I kept it casual in my trusty Monjur Straight Down Optic quarter-zip jacket and Monjur Fury hat, no slides, just stories.

I shared insights on our recent litigation victories where we leveraged AI for predictive models, fact-checking, and drafting. Engaging narratives painted a vivid picture of the litigated issues faced by companies like theirs.

Transitioning to our contracts-as-a-service solution, I impressed them with dynamic agreement updates via cutting-edge cloud tech. I compared Monjur to an antivirus update for customer contracts.

I explained how seamlessly our software integrates with existing applications and revealed our cost-effective pricing – less than 1 billable hour monthly, with exclusive group rates. We also offered personalized portfolio pricing for PE firms.

Concluding the presentation, I extended special pricing directly to the interested audience, making it easy for them to sign up on the spot. This is how Monjur won the Best Lunch and Learn Presentation at IT Nation for 2024.
