Unfortunately, some car dealers treat consumers like crap. Here’s an example of a totally scummy move by a dealer in Michigan. And even when they’re exposed in the media, their response is, “It’s totally legal.” No shame. Completely immoral.

How Long Do I Have To Respond To A Wrongful Repossession Of My Vehicle?

If someone believes that their vehicle was wrongfully repossessed, they should immediately call an attorney or consumer advocate. The first thing to determine is whether or not it was in fact wrongfully repossessed. In addition, it will need to be determined whether or not the company that repossessed the vehicle broke into a garage or otherwise disturbed the peace in the process of repossessing it. The term wrongful repossession gives rise to many potential claims that will need to be identified as quickly as possible while the consumer’s memory is fresh and all of the information is available to them. What Items Can Be Removed From A Credit Report?

It is important for consumers to know that there is no affirmative duty for a company to report anything, which means a consumer cannot sue someone for not reporting true information. For example, if a consumer purchases a car, they might be told by the car dealer that the purchase will improve their credit if they were to make all of the payments on time, but that car dealer would have no duty under the law to report any information to credit reporting agencies. While anything can be removed from a credit report, we usually deal with the removal of items which are objectively false. For instance, if someone makes all of their payments on time but suddenly finds a 30-day late fee from two years prior, then that is something that could be challenged. Learn here:

What Damages Can I Recover If I File A Lawsuit Under The Fair Credit Reporting Act?

Under the Fair Credit Reporting Act, a person can sue for damages that arise from the credit bureau or furnisher of false information’s failure to reinvestigate reasonably, but cannot sue for false information that someone is reporting on their credit report. For this reason, many cases in the federal courts get thrown out. Anyone who suspects they may be dealing with a credit reporting problem is advised to get a lawyer involved right away so that the letters that need to be sent are written correctly. If someone wants to rely on their own letter writing abilities or on advice that they found on the internet, then they will be running the risk of ending up back at square one. Learn here:

What Happens If My Home Goes Into Foreclosure?

If a person’s home goes into foreclosure, they should consult with an attorney to see whether or not the cause of the delinquency that led to the foreclosure can be challenged. There are many ways to have a foreclosure set aside, such as by working out a loan modification with the bank. Oftentimes, a consumer will have already tried to work out a loan modification with the bank prior to seeing us, but the bank will have lost documents or otherwise will have promised things they ultimately could not deliver. Once a lawyer gets involved, they might be able to shepherd the process through and obtain a loan modification before the debtor loses their house. Learn here:

What Is The Debt Buyer? How Does That Potentially Relate To My Debt?

A debt buyer is a company that buys debts. For instance, if a person owes company A $20, then company B can step into company A’s shoes and buy the right to collect that debt. Most debt buyers exclusively buy delinquent or defaulted debt. For example, 1,000 debts with an average balance of $1,000 on each debt would be equal to one million dollars’ worth of debt that the debt buyer could potentially collect. If the debt buyer were to buy that for five cents on the dollar and collect as close to the full amount as possible, then they could make close to 95 cents on the dollar. Learn here:
