Satawa Law has won another complex shaken baby syndrome/abusive head trauma case.
The client, a young father just starting a family, was accused of child abuse for intentionally shaking and abusing his 1-month-old daughter.
Daughter has difficulty sleeping one night. The next day, she has seizures – starts screaming, stops breathing, then becomes unresponsive and goes limp. Parents rush her to the ER. Hospital performs a CT, which was possibly abnormal, but is further analyzed and dismissed as an artifact. Child is then transferred to DeVos Children's Hospital. A second CT is done, which confirms no subdural hemorrhage, fluid collection is likely an artifact. Child is released the next day, diagnosed with a BRUE – brief resolved unexplained event.
Two days later, infant has another night of difficulty sleeping. The next days she has seizures again while in the care of the father, with the exact same symptoms – starts screaming, stops breathing, then becomes unresponsive and goes limp. Parents rush child to the same local ER, Child is then transferred to Munson hospital, and then DeVos. An MRI is done, which shows subdural hematoma of various ages. Infant is immediately diagnosed with abusive head trauma/shaken baby syndrome. Now they opine May 29 CT was likely misread. A later bone survey shows a corner metaphysical fracture (possibly healing). Follow up radiology is requested.
Follow up X-ray of the femur done at DeVos on June 18 shows that the spur is resolved, but the radiologist says that the corner metaphysical lesion is gone, so it must be “healing.” However, a bone survey done June 20 at a different facility in Marquette, MI shows nothing: no acute, chronic, or healing findings, and no radiographic evidence of any fractures.
Held a contested preliminary exam, where the district court judge expressed serious doubts about the case, and called the cross examination of the child abuse pediatrician the best cross of an expert he had ever seen. Filed a motion to quash the information and dismiss the charges, arguing that they did not prove a crime was committed (that the injuries were caused by abusive shaking), and even if they did, there is ZERO proof of who committed the crime (who abused the child).
The court just granted the motion and dismissed all charges.
Justice achieved. A family reunited.
