Estate planning, business structuring, asset protection, tax planning, Medicaid planning, and probate for families and business owners in Utah and Idaho.

Your operating agreement and your estate plan have to talk to each other.

A trust that leaves the LLC to the family, and an operating agreement that blocks the transfer or forces a buyout, are two plans that cancel each other out.

Who votes if you die? Who can become a member, not just an assignee? Was the membership ever assigned into the trust at all?

Owners need one system: who runs the company, who inherits the value, and how death or disability does not freeze the business.

If you have both documents, bring them. teamdgw.com

Three Medicaid myths.

Giving the house to the kids is not a plan. Utah looks back 60 months on gifts when you apply for long-term care Medicaid.

A revocable living trust does not hide assets from Medicaid. It is still you.

Waiting until someone is already in a facility is when the look-back, spend-down, and exemption rules are already in motion. DIY transfers are how families make a hard season harder.

What counts depends on the asset, the spouse, and the timing. That is not a form.

An unfunded trust is a stack of paper.

The trust only controls what it owns. If the house, accounts, and business interests are still in your name, your family can still end up in probate. A pour-over will is a backstop, not a plan.

Funding means deeds, retitled accounts, assigned LLC interests, and beneficiary designations that match the documents.

Same rule for an asset-protection trust: the statute does not cover what you never moved.

The question is not "did I sign it?" It is "what is actually in it?"

Utah is one of a few states that allow a domestic asset protection trust.

It is irrevocable, governed by Utah law, and needs a Utah trustee. You can be a beneficiary. You cannot treat it like a revocable living trust.

It is for people with real exposure: owners, landlords, professionals, families who cannot afford to lose what they have built.

It is not a way to hide from a lawsuit that already exists, child support, or taxes. And a signed trust with nothing in it is just paper.
