By Barbara Liston ORLANDO, Fla. (Reuters) - SeaWorld, the U.S. theme park operator whose treatment of killer whales has sparked criticism, said on Thursday it would no longer send employees undercover to infiltrate the animal rights group People for the Ethical Treatment of Animals. Finally, good news for struggling homeowners and especially those who lost their homes to banks which did not own their note. The California Supreme Court recently rendered a decision in Yvanova v. New Century Mortgage Corporation. Contact me if you want and in depth analysis of the Court's decision. But, personally, I am thrilled that the Court overturned that part of the decision in Jenkins which holds that a homeowner, behind in mortgage loan payments, cannot suffer prejudice if an entity, which does not own the debt, forecloses. The Jenkins Court reasoned that the homeowner owes mortgage payments to someone so it does not matter if the foreclosing entity has no authority to sell a struggling homeowner's property in foreclosure. Jenkins made it almost impossible for a homeowner to obtain relief if the home was sold in foreclosure. Now that is all changed. Kudos to those who fought, sucessfully, to have the Glaski decision published in the first place and to Kamala Harris's office for filing a very persuasive Amicus Brief.
