Starting today, August 21, 2026, USCIS will implement updated procedures for rescheduling affirmative asylum interviews. Applicants MUST establish either “good cause” or “exceptional circumstances” to reschedule an interview, and USCIS will no longer issue Warning notices.

“Good cause” is not defined and USCIS will likely use it to just blanketly deny the request ‼️

“Exceptional circumstances” mean
Battery or extreme cruelty to you or your child or parent;
Serious illness of you or your spouse, child or parent; or
The death of your spouse, child or parent; and
maybe ‼️ something else…

El 21 de julio de 2026, un tribunal federal suspendió temporalmente una política de USCIS que reducía a un año la vigencia de ciertos permisos de trabajo relacionados con TPS. In the new BIA order of April 24, 2026, the Board sent the case back for a do-over because (1) the judge’s spouse publicly advocated on behalf of the DACA recipient while the case was pending, which raised concerns of potential bias and undermined the appearance of impartiality required in fair proceedings, and the judge refused to recuse himself, and (2) the judge failed to consider all the facts of the case presented—WHICH THEY MUST DO IN EVERY CASE —and not just the existence of DACA. So, the case is a procedural mess, not a legal one! The Dreamer still has a chance to win her case this time.
