Celebrate! After two years of ceaseless work, we finally secured the final $485,000 payment on a non-dischargeable judgment. California's legislature has passed the long-awaited Homestead Increase Bill, which would raise the current homestead exemption from a flat $75,000/100,000/175,000, to an adjustable number based on the median price of homes, minimum $300,000, maximum $600,000. This is HUGE news for anybody with a home who has been contemplating filing a bankruptcy, as the homestead exemption is frequently the thing that determines whether a homeowner can file a simple Chapter 7, or a 3-5 year payment plan Chapter 13.

It took a year, but we finally received the first payment towards an Adversarial Proceeding settlement. $150,000. Looking forward to the next one in (hopefully) 6 months.

An important consideration when you are mediating an adversary proceeding is whether you will ever actually be able to collect whatever judgment you get. You may have a judgment for $250,000. But if the debtor's home is being foreclosed and they don't have a job, what is that paper worth? Maybe the $12,000 offer isn't *that* bad. Never let your ego get the better of your common sense.
