I started the Harville Law Firm, LLC, because I wanted to help people who found themselves in need of legal representation. For three years, I served in Brooklyn Family Court in New York City. During this time, I worked alongside the NYPD, prosecuting juveniles who had been arrested for crimes ranging from shoplifting, to joy riding, to armed robbery. During this time, I was challenged by criminal

defense attorneys who vigorously defended their clients who had been charged with petty to horrendous crimes. During this time, not only was I able to gain valuable experience in criminal law and trials, but also I learned how to assist clients from a variety of social and economic backgrounds. More importantly, I learned the impact that facing criminal charges can have on an individual's life. This time serving the City of New York taught me how important it is for a criminal defense attorney to offer the competent and courteous legal representation that I strive to provide to each client. This is exactly the criminal defense representation that I would seek to give you or your relative in all Louisiana state courts and in federal courts in the Middle and Western Districts of Louisiana and in the Eastern District of Texas, as well as in the United States Fifth Circuit Court of Appeals. Over the almost four years that I have practiced as The Harville Law Firm, LLC, I have enjoyed helping ordinary people by using my experience defending companies, corporations, and cities. A reminder that legal, lawful, and constitutional are aspirational terms that often do not equate to moral, Christian, or whatever principles guide your conscience. The United States Supreme Court doesn’t always get it right. Congress and Presidents likewise have been, are, and will always be flawed. Political parties serve a goal that far too often is removed from morality.

We must always do better for our children, our fellow countrymen, and those with whom we share this planet. We must always check the majority and weigh our individual and societal values against compassion, justice, and morality.

Plessy v. Ferguson is a legal case in which the U.S. Supreme Court on May 18, 1896, by a seven-to-one majority (one justice did not participate), advanced the controversial ‘separate but equal’ doctrine for assessing the constitutionality of racial segregation laws.

Something I love about my job is being able to donate time to defend organizations like Crime Stoppers successfully at the trial and appellate levels, to help a small business reverse a trial loss on appeal, and to help defend a motion to quash a murder charge. It’s nice to help the good guys win and to protect their wins.

Today, Louisiana defendants won. Proud to be a part of the LACDL and the Amicus Committee that stood with the defense.

From the opinion:

This matter is before us on a challenge to the constitutionality of La. R.S. 15:168(E)(3), which prohibits courts from ordering the payment of funds administered by the Office of the State Public Defender or district public defender. The district court held that the statute was unconstitutional in violation of Louisiana Constitution Article 5, § 16(A), which gives exclusive original jurisdiction of felony cases to district courts. We affirm the district court’s judgment and remand for further proceedings.

The statute enacted by the Legislature in La. R.S. 15:168(E)(3) is inconsistent with the historical analysis and implementation of payment of the expense for indigent counsel. It is contrary to the jurisprudence which holds that the state bears responsibility for the funds required while the courts have the duty to determine what payments are necessary. The statute ultimately infringes on the courts’ constitutional authority and inherent power to oversee and manage criminal prosecutions.

Today, the United States Fifth Circuit Court of Appeals tentatively set another of my cases for oral argument in July. Hopefully, the oral argument will be set in the first full week of July.

Two oral arguments in two months would be an amazing opportunity to give another client a voice before the judges who will decide his case.

So many times, my clients have just needed someone to stand with them. It is an honor to do so as we press the case forward.

The United States Fifth Circuit Court of Appeals granted oral argument in one of my civil appeals. I always love getting to present my client’s case before the panel that will decide the case.

Oral arguments are challenging. Opposing counsel are always well prepared and argue effectively for their clients. The judges are prepared and ask difficult questions. It is the best sort of challenge.
