My daughter is disabled and I want to make sure she is protected when I pass away, what are my options?

The best thing you can do is make sure that your estate plan is in proper order. You could establish a Third Party Special Needs Trust for her now, and fund it upon your passing. With the right estate planning documents, you can ensure your daughter is not in Probate Court later, and that she pays the least amount in taxes. Most importantly, a Special Needs Trust will ensure that she maintains her current disability benefits.

What assets are exempt for Medicaid purposes?

In Michigan, your primary residence, one vehicle, certain life insurance policies with a face value under $1,500, and personal belongings are not countable for Medicaid purposes. Although, there are still exceptions to these exemptions, so be sure to consult with your Elder Law Attorney.
