When I defend lawsuits for people, it helps significantly when they are organized and have been careful. Working from a "blank slate" allows us to consider a full range of legal options and preserve defenses. This article discusses 15 things that defendants do that can harm their ability to defend a civil lawsuit.

I'm always amazed at how many lawsuits are filed each election season. On one hand, it's somewhat sad that judges are forced to referee so many election disputes. On the other hand, election laws are complex and it is important to interpret them properly. It will be interesting to see how much "flexibility" judges find in election laws that are impacted by Covid this year.

Democrats and Republicans are involved in hundreds of lawsuits across the country relating to the upcoming election

Counterclaims are a central part of civil litigation, but often misunderstood. They can be an important option for Defendants and a risk for Plaintiffs. Having an awareness of counterclaims can help parties find their best strategy for the case.

This is a good lesson for anyone wiring funds. Make sure you're sending the right amount of money to the right people. Recovering mistaken wires is not always easy, as Citibank's lawyers are finding out.

Even for Citigroup Inc., it was big money. On Wednesday, loan operations staff at the New York bank wired $900 million, seemingly on behalf of Revlon Inc., to lenders of the troubled cosmetics giant controlled by billionaire Ron Perelman.

Sometimes, when people wait too long to take legal action, they can unfortunately end up losing their claim. Laches is a defense to a civil claim when the delay hurts the defendant's ability to defend the case (witnesses or evidence are now gone). It takes unique facts to support a laches defense, but if successful it can be a blow to a plaintiff's case.

People sometimes create problems when they "assign" (transfer) contract rights without fully understanding the consequences. Assignment involves a new person coming in to perform the contract. If that person does not fully perform the original contract, then all parties can be impacted.

Assignment of Contracts in Minnesota - 10 Things to Know Posted by Christopher A. Jensen | Jul 15, 2020 | 0 Comments If you are a party to a contract, you may have the right to transfer your contract rights to another person. This is called an “assignment” of the contract. Basically, assignment ...

When pushing someone to close a deal and sign a contract, there is a fine line. Aggressive negotiators can often get more favorable terms into a contract. But people sometimes cross the line when they threaten or coerce the person to sign the contract. This can potentially create a "duress" defense and can risk the entire contract.

Duress: A Breach-of-Contract Defense in Minnesota Posted by Christopher A. Jensen | Jun 29, 2020 | 0 Comments Photo by Sonja Guina on Unsplash People sometimes feel pressure to sign a new contract, perhaps at the insistence of the other party. At what point does that pressure void the contract? “D...

The U.S. Supreme Court decides its most controversial cases in late-June of each year. Their website has the full "slip" opinions (current ones - not just 2008 as the link says) and audio from the oral arguments. These can be more educational and accurate than news headlines. In the next week, there will be important decisions involving abortion, religious rights, Trump taxes and immunity, and the validity of the consumer protection bureau.

“Slip” opinions are the first version of the Court’s opinions posted on this website. A “slip” opinion consists of the majority or principal opinion, any concurring or dissenting opinions written by the Justices, and a prefatory syllabus prepared by the Reporter’s Office that summarizes ...

Invoicing is a standard business practice that helps companies get paid. But invoices can also be a source of disputes. The person receiving an invoice must promptly object to any incorrect balance. If not, the invoice itself can be used to recover from the other person (and the balance will be assumed to be correct). This often comes up with credit card disputes.

If the customer fails to pay the invoice, what can th...

It's good to be flexible and cooperative with the other party to a contract, especially with the economic disruptions. But what if the other party breaches the contract and you continue the contract without objecting? The risk is that you could "waive" your right to sue for breach of contract.

The Waiver Defense to Breach of Contract in Minnesota Posted by Christopher A. Jensen | May 26, 2020 | 0 Comments Photo by Camylla Battani on Unsplash If one party breaches a contract, the other party generally has a right to sue. However, that party must assert his or her rights. If the person is n...

This question will almost certainly come up. People might bring lawsuits for negligent exposure to the coronavirus (or a similar legal theory). I'm not a personal injury lawyer, but the "standard of care" that a business owes to workers/patrons may depend on government guidelines. As such, businesses may need to consider those guidelines to limit their liability risks.

With many Minnesota bars and restaurants reopening June 1 in the midst of the pandemic, legal questions hang in the air about a business's responsibility in keeping everyone involved safe and healthy.

With an increase in contract disputes, people are looking for ways to defend breach-of-contract claims. Two defenses that might apply are "adhesion" and "unconscionability". If the contract is extremely unfair and one party took advantage of a weaker party, a court can invalidate the contract. It doesn't always work, but is an option to consider.

Adhesion Contracts and the Unconscionability Defense in Minnesota Posted by Christopher A.
