How does the Covid-19 Pandemic and the Governor's 'stay at home' order effect parenting time?

The Indiana Supreme Court has finally weighed in on this issue by way of an Order date March 31, 2020.

The short answer, all parenting time orders currently in place are to be followed unless you and the other parent can reach an agreement otherwise. If you do have an agreement that is different than the current Order in your case, you can file that as a temporary agreement with the Court, but you are not required to do so.

If you believe there are special circumstances in your case that would make it not appropriate to follow the current order then it would be necessary to file an emergency petition to modify that existing Order.

We’ve talked quite a bit about not talking to the police, but here’s something else that should be standard operating procedure: Don’t sign a paternity affidavit at the hospital!

This little form has HUGE implications for many years and most people who execute one are not aware of the effects of this document.

It is completely voluntary.. you don’t have to sign this at all.. but if you do, were you aware that:

1. Even if you later determine via genetic testing that you are not the parent you will probably not be successful in having paternity reversed (meaning you could pay support on a child not your own for 19 years)?

2. The father is automatically granted guideline parenting time without the need for a court order.. (Prior to 2017 the mother had sole custody and there was no parenting time until a Court ordered the same.. but now the father will be entitle to every other weekend, half the summer, etc. without ever going to Court.. whether you are still in a relationship with him or not)?

3. You can always sign a paternity affidavit at any time prior to the child being emancipated (usually age 19) at the health department?

Seek advise of counsel before you sign a paternity affidavit!

We at Smith Law Services wish you and yours a Happy New Year. As you plan your celebrations remember that under Social Host Law you have a responsibility for your guests.

If someone leaves your home or place of business in an intoxicated state and is involved in an accident, you can be held liable. And serving underage guests is a crime pursuant to IC 7.1-5-7-8. If serious injury or death occurs, you could be charged with a felony. So keep an eye on your guests and don't let them drive if they've over-imbibed.

AAA suggest you follow the ABC's of party hosting.

A – Alcohol Awareness
Ask your guests to choose a designated driver for the evening. Have a car key collection when your guests arrive. Mix drinks yourself and avoid open bars. Stop serving alcohol 90 minutes before the party is over.

B – Buffet
Always serve high protein foods such as meats and cheeses. They stay in the stomach longer and slow down the rate of intoxication. Starchy foods are great too. Minimize salt. Salt makes people thirsty and speeds up intoxication. Always provide non-alcoholic beverages such as “mocktails,” soft drinks, juices and punch.

C – Carpool
Remember: only TIME will make your guests sober. It takes one hour for the body to process the average drink. 5 ounces of wine, 12 ounces of beer and 1.5 ounces of liquor contain about the same amount of alcohol. Keep watch on behavior. Arrange a cab, ride with a designated driver, or invite intoxicated friends to sleep over. For irate guests, “hide” their keys until they have found another ride home.
