Lesson for the day regarding the Alabama Rules of Professional Conduct.

Scenario: Your 27 year old daughter has been arrested and is now in jail. She has been appointed an attorney to represent her. You’re in court and give your contact information to the attorney to get information about the case. You speak to the attorney to give info that you have in the case. Months pass and the attorney is working on the case, and appearing in court. However, the attorney has not called to update you about the case. Why?

Client-Lawyer Relationship.

Rule 1.6:
Confidentiality of Information

(a) A lawyer shall not reveal information relating to representation of a client unless the client consents after consultation, except for disclosures that are impliedly authorized in order to carry out the representation, and except as stated in paragraph (b).
(b) A lawyer may reveal such information to the extent the lawyer reasonably believes necessary:
(1) To prevent the client from committing a criminal act that the lawyer believes is likely to result in imminent death or substantial bodily harm; or
(2) To establish a claim or defense on behalf of the lawyer in a controversy between the lawyer and the client, to establish a defense to a criminal charge or civil claim against the lawyer based upon conduct in which the client was involved, or to respond to allegations in any proceeding concerning the lawyer's representation of the client.

HOWEVER, rules of professional conduct (Ethics) prevents us. If your child wanted you to know, they would tell you. You should ask them.

Demonstration of facial control…. The court reporter listening to an absurd argument from an attorney, her eyes brightening, the corners of her mouth starting to inch upwards into a smile, then suddenly snaps back into a blank face. It happened so quickly that if you weren’t paying attention to her, you would have missed it. I had to hold in my laughter. I could not believe it. 😂 The things court reporters must hear daily.
