Ah, traffic tickets.

These are not my bread and butter criminal offenses. These are plain traffic citations filed in the court with TR case numbers assigned. I usually don't get involved in these. The fine is usually much less than what you're gonna pay me and if the officer shows up and is believable, you're out the money you paid me and the money you'll have to pay for the ticket. not to mention, you can probably avoid the adjudication and point yourself by picking the right option.

But sometimes, it's fun to roll the dice. Especially on careless driving cases. The great thing about careless driving is that most times it doesn't matter what the officer has to say. They came after the fact. In Monday's case, my client was alleged to have failed to move over and run an officer off the road then charged with careless driving.

It was so egregious *eye-roll* that the officer didn't even bother writing a report. So when the time came to subpoena witnesses, the only witness is the LEO, who signed the report.

I talked to the LEO like I always do before hearing and realized that there was going to be no witness to the infraction present. Without that, their testimony is hearsay as far as what the other officer would've had to say, and my client's statements were subject to the accident report privilege. With that objection sustained, the LEO had nothing else to provide, and my client was found not guilty.

ANOTHER SUCCESSFUL DOMESTIC VIOLENCE RESOLUTION!


As happens so often - and as you have read in my posts before - it's so common that something gets out of hand at home and results in a 911 call. The end result of that is that the cops get involved; the case drops into the system, and a household is fractured and waiting to see what happens next.

With the victim's cooperation and a proactive client, we were able to convince the state to dismiss these charges before they even made it to arraignment and this is the review I got once it was all said and done. Thanks for the feedback J.P, I try!

After a year and a half working as a true solo reimagining my practice and procedures, the practice is thriving and has grown enough to require some assistance. Ash has been doing contract work for me for several months and has shown herself to be indispensable in all areas of the business, from client contact to legal assistance to bringing my dream of a Florida native landscaping project around the Sebring office to fruition.

My assistant Ash took this picture. I adore this picture not because it's a picture of me "in the wild", but because of the way it captures the courthouse façade.

Many, many moons ago, when I was a fledgling public defender (and later young prosecutor) in Sebring, that was the back of my courthouse. The new wing was added later and kept the façade. it was necessary and they did a pretty good job with it, but I always joked that it looked outside like they slapped a triple wide onto the back of the courthouse.

Since 2000, I've lived in Sebring, moved away, been drawn back to Sebring, moved away and continue practicing in Sebring, which I consider my flagship office. All these years later, no matter where else I practice, the Highlands County Courthouses feels like home.

Two more super speeder dismissals today! We worked hard to get these results but I do truly want to thank the prosecutors that were willing to take a close look at these cases and do the right thing so we wouldn't have to take our chances on a trier of fact. Successful advocacy is a balance between zealous, but measured, aggression and a good working relationship with those who have the power and discretion to do justice.

If you or someone you know are arrested and charged with this or any other type of offense, bear in mind that no criminal case is too small to benefit from good legal representation. Lawyer up before you walk into a courtroom. Never go it alone.

CASE DISMISSED - The Super Speeder law has become a pet project for me this year. Paying close attention to the F.S. 316.1922 there’s two ways to get tagged under the new law. 1) you are going 50+ mph over the limit, (in which case it’s basically strict liability) and 2) you are going 100 or more AND dangerous driving is alleged. This is a lot like the reckless driving statute and it’s case law– you cannot prove a reckless driving by speed alone. There has to be something else.

Most officers I’ve seen are seeing 100+ and immediately charging super speeder without so much as trying to allege dangerous driving. On such cases I have been filing C4 Motions to Dismiss - essentially arguing the affidavit’s failure to state a cause of action. Also, a Motion to Dismiss on Constitutional Grounds arguing not the statue is vague and fails to clearly put a driver on notice as to what behavior is legal, criminal, or just a civil infraction and therefore such confusion renders the statue void for vagueness.

In most of those cases, I’ve gotten a favorable resolution from the prosecutor or outright dismissal. Got another one last week. The fight continues as I keep trying to make some new law on this. In the meantime I’m glad for reasonable prosecutors willing to take a hard look at these and handle the cases reasonably.
