Made it to the end of another week of defending clients. The adventure continues on Tuesday. Have a happy and safe Memorial Day; don’t drink and drive! Uber and Lyft have been around too long at this point for that nonsense. You don’t want to have to spend that money you saved on rideshare to hire me or my colleagues (and remember, there’s no DUI Diversion in the Tenth)😬.

TMW when you’ve set the camera angle too wide for a video and the lens distortion makes you look like a RL Bobblehead so you just call the whole thing off. Maybe next time I should take a page out of David Byrne’s book and wear a giant suit to make my giant head look smaller.

I rarely say no because I either don’t vibe with the client or think they have a terrible case that I want no part of. More often than not, I say no because I can see a path through a desired result that doesn’t involve them spending their hard earned money on an attorney if it’s not necessary (particularly when it comes to juveniles). If I’m going to take someone’s money, it’s because I think I can deliver some significant value or the client really wants to make the spend no matter what. Here’s an example.

CASE WIN! Injunction dismissed after hearing. Once again, I had a client with the misfortune of being on the receiving end of an injunction petition based on false allegations in a naked attempt to gain leverage in a brewing custody dispute. The court had granted an ex parte temporary Injunction, which prevented my client from having contact with the petitioner, but also was unable to contact their kids for a week.

Petitioner realized the error of their ways when it came to the children, and backed off that part of it thinking we would agree to an Injunction if it did restrict contact with the kids. Client was just about to agree to it when I encouraged that we just go through with this and mop the floor with the Petitioner.

After a brief presentation by the petitioner and my pointed cross-examination establishing that there was zero fear warranty and Injunction, the Judge sua spine dismissed the Injunction without need for the Respondent to present further evidence or argument. Too often I see people roll over on an Injunction for minor or no charge concessions - even when represented by an attorney. Don’t do it. Lawyer up and take it to the mats!

SUPER SPEEDER SUCCESSFUL OUTCOME!

Client stopped for speeding and officer made decision to arrest under 316.1922(b), alleging speed over 100mph and dangerous driving along with some drug charges. I have been challenging the 100 mph super cases by filing C4 motions to dismiss, arguing that speed is not enough and that dangerous driving must be alleged. Without that dangerous driving, there is no criminal offense. I have also been challenging these cases on a constitutional basis, arguing that the statute is void for vagueness.

I moved quickly and aggressively on this case and filed those motions prior to arraignment as required by the rule. Typically, prosecutors have seen those motions, shrugged their shoulders, and said set it for hearing and/ or offered fine and court costs but refused to reduce it to a Careless Driving or Speeding citation.

In this matter, a reasonable prosecutor actually took a look at the case, found it was weak enough to not be worth the trouble, and offered a plea to paraphernalia with a withhold of adjudication and monetary obligations while dropping all other charges. From hire to resolution in 7 days.

I still looking forward to litigating this issue and making some new law on the super speeder question, but it will have to wait for another day. My decisions as counsel need to be made in conjunction with the best interests of the client and their desires re:risk management or convenience, not solely on my desire to fight or make a name for myself.

Had a great time chatting with Amber and Kaylee on the Hardee Chamber’s of Commerce’s podcast. Such a good time, in fact, that I forgot to take a studio selfie. Made sure to shout-out the good work done by the PDs, Dan at and his fantastic Peace River tours and my fantastic fortune at having the wall outside my office graced by the lovely Sandhills Crane mural designed .

Hiring an attorney. Is it really a simple as a vibe check? Well maybe not that simple, but at the end of the day, with all of the factors being equal, you’re gonna make your decision based on that vibe check and how you feel.
