Headed to Baltimore as one of the presenters at the annual meeting of the National Medicare Secondary Payer Network. It’s an opportunity for MSP professionals to interface with CMS and others who consult on Medicare secondary payer compliance. An obscure group to be certain, but one dedicated to making sure people who receive personal injury settlements can keep their Medicare benefits. I will be presenting on how to make sure the language in settlement agreements protects personal injury claimants. And maybe I’ll eat some crab. It IS Baltimore!

Allstate’s subsidiary National General is being sued by the US Justice Department because the insurer was charging some auto loan customers of Wells Fargo for insurance they already had.

Wells contracted with National General to help it determine if new auto loan customers had enough insurance coverage to qualify for financing. Instead of doing that, National General just added new auto policies to every new loan - even when that customer already had other auto insurance. This was done without the customer’s agreement, adding hundreds of dollars to monthly loan payments.

National General sold over a million of these unnecessary policies, and while some of them were cancelled when the unnecessary coverage was discovered, most were not. The company earned over 500 million dollars from these fraudulently issued policies.

An Allstate-owned insurance company is facing a lawsuit from the U.S. government for allegedly defrauding customers.

Few things would do more good for gun violence in our country than civil liability for gun manufacturers for the damage their products cause. More exposure to claims would make them vigilant about who they let buy their products and how those products are used. If you sell inherently dangerous things, you must be accountable.

This is such an important step. Moving sexual assault cases outside the military chain of command gives victims a chance to have non-military legal pros identify those cases which desperately need prosecution.

The investigation and prosecution of major criminal offenses now shifts to independent prosecutors in a bid to strengthen the accountability of the military justice system.

Second amendment rights are not absolute. When domestic abusers have guns they are significantly more likely to use them on a family member. If smart gun control should start anywhere, it’s here. My suggestion? Get rid of gun manufacturers’ immunity to being sued by gun victims. Do that, and they will be much more careful about who can buy a gun.

Autopilot for cars is not ready to be used safely, because no driver can fully appreciate the limitations of the software. Accepting the “terms of service” is only useful if the person accepting the terms has had some training/experience with it before taking it onto the road. Driving requires judgment, and that hasn’t been duplicated with technology, yet.

A lawsuit over the crash could determine whether the maker of the technology bears some responsibility when things go wrong in a vehicle guided by Autopilot.
