By January 1, 2028, nearly every Washington HOA and condominium association will be subject to WUCIOA's governance requirements.

If your community hasn't reviewed its CC&Rs, bylaws, rules, or policies in years, now may be the time to start. Many older governing documents contain provisions that may no longer align with current Washington law.

Proactive planning today can help reduce legal risk, improve transparency, and avoid costly disputes in the future.

Episode 10: Surrender Clauses and Commercial Leases

When negotiating a commercial lease, many tenants focus on their obligations during the lease term, but what about when it ends?

That’s where the surrender clause comes in. It determines what happens when a tenant returns the premises at lease expiration or earlier termination. While surrender clauses can cover many issues, there are three key things you should always watch for: timing, alterations, and consideration.

In this episode of Quick Insights, Michael Gladstein explains why these details matter.

Important Update for Washington Landlords!

A new law passed in response to the severe flooding that affected Western Washington in 2025 will require landlords to disclose potential flood risks to tenants.

Under Senate Bill 6237, effective June 11, 2026, landlords will be required to provide flood risk disclosures for residential leases entered into after December 31, 2026. The disclosure must inform tenants about potential flood hazards, limitations of landlord insurance coverage, and available local resources regarding property-related risks.

While this new requirement only applies to new leases, landlord should start reviewing and updating their lease agreements to ensure compliance.
