We have represented multiple insurers in condominium and multiple habitational losses, significant fire losses, fraud claims, issues of subrogation, natural disaster claims, and extra-contractual litigation. We have taken some of the most significant bad faith and coverage cases in the State of Washington to trial. Our injury group has handled a number of death and cataclysmic injury claims. Our attorneys are licensed in all Federal and State Courts in Washington, Oregon, Alaska, California, Idaho and Hawaii, as well as the Federal Court of Colorado, the Ninth Circuit Court of Appeals and the United States Supreme Court. Washington insurers should be watching proposed Senate Bill 5331, which would expand the Office of the Insurance Commissioner’s authority to order restitution and increase per-violation fines.

If passed, the bill could significantly raise regulatory and financial exposure for carriers operating in Washington. Now is a good time to review compliance procedures and documentation practices.

Newly elected Insurance Commissioner Patty Kuderer is backing House Bill 1199, which would allow direct restitution to affected consumers instead of fines going to the State’s general fund. The bill also proposes stricter penalties and a new claims review team.
