On July 1, 2023, in celebration of his 60th birthday, SFF founding member Jim Fick summited Mount Kilamanjaro in Tanzania, Africa. With the help of some amazing guides, Jim and his two sons climbed the 19,341 ft mountain in 7 days. 🥾

Beyond the personal triumph, Jim’s journey demonstrates that age is no obstacle when it comes to celebrating life’s milestones and embracing challenges head on.

At SFF we are incredibly proud to have an attorney like Jim, who not only excels in his legal practice but also embarks on extraordinary adventures that inspire us all. Jim’s commitment to personal growth and his unyielding pursuit of excellence makes him an invaluable asset to our firm. Way to go, Jim, and Happy Birthday! 🥳

Do you have a troublesome easement on your property?
Washington’s new Uniform Easement Relocation Act may provide some relief.

The Washington State Legislature just passed a new law, giving property owners the ability to seek relocation of an easement that is burdening their property.

Often, easement rights date back decades to a time when the property was used in an entirely different way. Today, those easements can create issues with development of property if they are inconveniently located. For example, an easement running through the middle of a property may leave inadequate space on the property to accomplish development needs. Under the new Uniform Easement Relocation Act, burdened property owners (also known as servient estate owners) have a private cause of action to request the easement on their property to be relocated to a more convenient location on their property. Of course, exceptions and restrictions apply. The law goes into effect on July 23, 2023.

If you have property burdened by an easement, or you are an easement holder, and you have questions about the location or relocation of your easement, call Schlemlein Fick & Franklin.

“Homeowners Association” or “HOA,” “Community Association,” and “Condominium Association” are all terms that evoke a wide range of emotions among those who live in housing communities with rules and regulations. If you are one of the 2.4 million Washingtonians who live in a community association,* you may already know that the rights and obligations of homeowners and board members can be confusing and hard to define depending on the situation.

If you are a homeowner in a community association or part of a community association board and you have questions, contact SFF. 🏡

Last night the SFF attorneys joined the WSBA Construction Law Section to honor retired Washington State Court of Appeals Chief Judge, Beth Andrus. Judge Andrus served as a King County Superior Court judge for 8 years before being appointed to the Court of Appeals in 2018. Even in retirement, Judge Andrus continues to provide mentorship and support to the Washington State Bar Association and its members. Thank you, Judge Andrus, for your service and dedication.

We would also like to thank HKA Construction for hosting this terrific event.
