Looking to work legally as a farm worker in the United States? Here's what you need to know:
๐ฑ **H-2A Visa Program**
This is the primary visa for temporary or seasonal agricultural jobs. Employers must apply through this program and prove no qualified U.S. workers are available.
โ
**Legal Work Status**
You must have proper authorization to work legally in the U.S., such as being a U.S. citizen, lawful permanent resident (green card holder), or holding a valid work visa like H-2A.
โ๏ธ **Other Programs**
Programs like DACA may offer eligibility, but they do not automatically grant work authorization. Check your specific circumstances.
๐ซ **Working Illegally**
Working without proper authorization is illegal and can result in deportation, visa bans, and other penalties.
Take the right steps to work legally and securely in the U.S. agriculture sector!

America needs vetted and legal farm workers to support our local agricultural businesses, and weโre working closely with U.S. Department of Labor to modernize and streamline the H-2A process.
Beginning Oct. 2, petitioners seeking unnamed beneficiaries will be able to electronically submit the newly developed Form I-129H2A after DOL issues a notice of acceptance on the H-2A temporary labor certification and before it is approved. USCIS does not approve any petitions until after DOL has approved the corresponding TLC. This change will allow USCIS to immediately begin the concurrent processing of electronically filed petitions with unnamed beneficiaries, allowing petitioners the flexibility to file a petition with USCIS sooner than previously permitted.
When workers choose lawful pathways to working in the United States, it is beneficial for American businesses, the public, and alien workers.
