I am often asked what documents do I need to have my affairs in order so my kids don’t have to worry. Here is a list of documents that definitely help make things easier if you become incapacitated or leave this earth, hopefully for your heavenly home.

-Last Will and Testament
Although every Will does not need to be probated, having a Will makes your wishes clear to your family and distributes your assets.

-Medical Power of Attorney
This allows whomever you appoint to make medical decisions for you when you cannot make them for yourself.

-HIPAA
This allow you to choose who has access to your medical records.

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a federal law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient's consent or knowledge.

-Directive to Physicians

What is a directive to physicians? A directive to physicians is a legal form, also known as a “living will.” It communicates your wishes about medical treatment at some time in the future, but only if your condition is irreversible or terminal. It speaks for you when you cannot speak for yourself.

-Statutory Durable Power of Attorney

This form is for designating an agent who is empowered to take certain actions regarding your property. It does not authorize anyone to make medical and other healthcare decisions for you.

This document appoints an agent to handle your affairs for you while a person is still living. You must choose when it goes into effect.

Some things to consider.

Make sure all of your bank accounts, retirement accounts, etc. have beneficiaries listed. These are not typically items that are listed in a Will.
