Nichol Fitzpatrick was a young mother when she embarked on a path in law enforcement that, over the next 26 years, would bring her into the courtroom to litigate complex custody and divorce cases. Today was another victory for children traumatized by abuse for two important families. Both involved documented cases with confirmation of domestic violence. One fell under the older statute, while the other fell under the , yet both were able to garner a similar result - protecting the child. At Code4 Legal, the sweeping changes to the domestic violence statute are not scary - but it does set us apart.

Have you heard about the overhaul of what constitutes domestic violence in family law cases? The changes are substantial! The big expectation that much of the public has is that because of the emergency provision that it is applicable in every family law case.. it's not. One big distinction is whether there is an active petition before the Court that was filed BEFORE the revision took effect.

Another big distinction is what now constitutes domestic violence. It's not only physical violence. And the consequence are significant.

The changes also mean that there may be a change in legal strategy, especially when the courts have not worked through all the changes yet.

A.I. in your custody or divorce case puts a lot on the line.
📌 Save this post for you or a friend in a DIY divorce or custody case. A.I. can be used in some ways without exposing you to an attorneys' fee order or discoverable information.
In a recent meet and greet with Maricopa County family law judges and attorneys, certain judges wanted to talk about the use of A.I. in the courtroom. Why? To press upon attorneys to seek sanctions and attorneys' fees when the opposing side is using A.I. because:
⚖️A.I. is notorious for making up (hallucinating) not only the language of a supposed case opinion, but also the citation of where a judge can find it.
⚖️A.I. commonly misquotes the wrong numbers for statutes and laws.
⚖️ A.I. can be used to falsify evidence - including alleged images, screenshots and videos. A.I. has already been used to in celebrity circles to masquerade as well-known singers and celebrities to say things that were never said. If there can be a knock-off Taylor Swift, isn't it within reason that there can be one of you in your case - perhaps doing things you have never done?
🔍Did you know that because you have no attorney-client privilege with A.I. that your search conversations are discoverable? That's right. When you are working with a law firm, you have privilege and do not have to produce documents or conversations about legal strategy or work product. You do not not have those same protections with A.I. when you are exploring legal theories. And once it becomes apparent to the other attorney that you are using A.I., that attorney is likely going to want discovery in that realm, especially for their attorneys' fees claim.
🎯 Use it to summarize evidence after pulling from reputable sources. A.I. can be used to comb through large amounts of messages and emails to summarize the contents.
🎯 Use it to review lengthy court transcripts looking for specific details and tell you where to find it.
🎯 Use it in bank records when you are looking for transfers in and out of bank accounts to identify hidden assets.
But be weary about uses that expose you to unnecessary risk.

Did you know there are hidden orders as part of the Child Support Order that affect long distance plan costs, out-of-pocket healthcare, and claiming kiddo on taxes? Did you also know this does 🙅‍♀️ NOT 🚫🚫include the cost of extracurricular activities? If you violate the hidden orders, you can be held in contempt for violating a child support order ... and that is a big deal.

💼Pro tip - Manage your finances with a better understanding of the Child Support Order.
(1) 💵💰It's Income Based not Time-Based. Your child support order will base the division of the Tax Benefit Allocation (who can claim kiddo in what years for taxes) and the division of out-of-pocket healthcare costs (everything - medical, dental, vision, orthodontics, therapy, etc.) on a proportionate share of income. For example, if we put all the income - from both parents - in a bucket, what percentage would come from you?
(2) What it is not. It does not cover everything and you should plan for that when reaching agreements, putting forth requests to the Court and planning out what you can afford. The most common area you will see this is in extracurricular activities (baseball, dance, club ball, etc.) and private tuition costs.
(3) There are credits with specific rules. The Court treat different circumstances differently. To maximize the benefit, we look to your unique situation.
(4) The Child Support Order also sets one parent as the one who is responsible for providing the healthcare coverage.
