🚨 Important Update: Changes to Independent Medical Examinations in NJ 🚨

New Jersey’s approach to Independent Medical Examinations (IMEs) has changed significantly following the DiFiore v. Pezic ruling and amendments to Rule 4:19-2. These updates shift the burden onto defendants to justify why a third-party observer should be excluded from an IME.

🔹 Key Changes:
✔️ Plaintiffs now have more power to bring third-party observers to IMEs.
✔️ Defendants must seek a protective order if they want to challenge an observer.
✔️ The court will evaluate cases based on factors like age, communication abilities, and psychological impairments.

🔸 What This Means for Defendants:
📌 Prepare for increased scrutiny in IME disputes.
📌 Consult with IME experts about observer presence.
📌 Assess the neutrality and necessity of third-party observers.

💡 A proactive legal strategy is essential to navigate these new IME procedures effectively. Stay informed and plan accordingly!

🚨 Major NLRB Update: Changes to Non-Compete & Stay-or-Pay Agreements 🚨

In a big shift for employers, the NLRB has rescinded prior restrictions on non-compete and stay-or-pay agreements. This decision grants businesses more flexibility in enforcing restrictive covenants, but legal risks remain.

🔹 What’s Changing?
✅ Employers may now have more freedom to implement non-compete clauses.
✅ Stay-or-pay agreements are no longer automatically deemed NLRA violations.
✅ State laws still apply—compliance remains key.

🔸 What This Means for Employers:
📌 Review and update your agreements.
📌 Balance business interests with legal risk.
📌 Stay informed on ongoing NLRB and state-level changes.

💡 Proactive steps and legal guidance are crucial to navigate this evolving regulatory landscape!

Recently, SPG’s personal injury team recovered $275,000.00 for the estate of an 82-year-old woman who died while in the care of a rehabilitation facility. The Plaintiff alleged that while in the facility’s care, the woman fell from a Hyer lift, caused by a severed strap. As a result, the woman sustained a significant closed head injury which ultimately led to her passing five days later.
