When disaster strikes, renters often bear the brunt of the uncertainty that follows. After devastating fires swept through parts of Los Angeles County earlier this year, many renters returned to homes filled with toxic ash and smoke, only to learn there was no clear rule about who should clean it up.

SB 610, recently signed by Governor Gavin Newsom, makes it clear that landlords are responsible for cleaning and repairing rental homes damaged by natural disasters.

Under SB 610, when disasters cause damage to rental housing, landlords must remediate hazards such as mold, smoke, ash, asbestos, and water damage before tenants can safely return. The law also requires landlords to return rent payments for any months when tenants could not occupy their homes and to allow tenants to move back in at their pre-disaster rental rate once repairs are complete.

While SB 610 may have been prompted by recent events elsewhere in California, its protections reflect lessons learned here in Sonoma County. When homes are compromised by disaster, we must ensure the most vulnerable tenants are not left behind.

Legal Aid of Sonoma County stands behind laws like SB 610 that protect renters and ensure every Californian has access to safe, habitable housing.

Local officials told renters they couldn’t force landlords to clean ash-covered homes. A new state law, inspired in part by LAist’s reporting, clarifies who’s responsible.
