It will be interesting to see how generative AI sees our business and how your favorite notaries look a year from now. This one’s pretty funny but it gets the happy holidays message across.

We are available for emergencies this weekend but plan on being back on schedule on Tuesday for a few days before New Year’s weekend.

Happy Holidays!

Hope you are taking the day off like us! We will be back at it tomorrow. Happy Thanksgiving!

Our latest blog post looking at "getting your affairs in order". There's no time like the present!

I’ve heard a lot about people “getting their affairs in order” over the years, much of which needs to be notarized. If you or a loved one is advancing in age and even if not, there are a couple things to think about and take action on now to make things easier in your later years.

This week I had a lot of back and forth with a loan company about notarizing someone as “Jane Doe, Trustee, Jane Doe Trust”. This is allowed in places like Florida but not in California. They pushed back saying they’d done their own research!

The truth is that we aren’t allowed to as per California Civil Code.

In California, we notarize individuals in that we are confirming their identity but not who or what they represent. Capacity is legalese for a person’s title like if they were CEO of a company. The idea behind this is that it’s not our job to confirm someone is a trustee as that’s really the job of an attorney and not a notary public.

Now, in the document itself — there can be a signature line for the signer with their capacity written underneath their name. Here, the signer is acknowledging that their capacity is associated as “Trustee, Jane Doe Trust”.

As always, if you need a notarization in the Santa Barbara area, contact us at a

CNN reported today that a document claiming to change the trust of Lisa Marie Presley (who recently passed at age 54) was not notarized and that the signature did not look like hers, among other issues. We can leave what really happened for the courts to decide but this example points to the important role of the notary public in the estate planning process.

First, we want to wish you all happy holidays no matter what you celebrate during this season of joy. This has been an up-and-down year for us as we started the year with a boom period with refinances and loan signings taking up much of our time. Around June, they started slowing down quite a bit and now at the end of the year, they are fewer and farther between due to higher interest rates. We remember when interest rates were as high as 18% but today’s 5-6% seems like a shock to many. We know that there are cycles and are holding tight for the new year where we hope that the housing market responds to slower inflation.

We are blessed to have a consistent customer base that keeps on calling us for all of their notarial needs. One thing that the pandemic period brought everyone is a focus on making sure estate paperwork is in order and we continue to notarize trust documents and packages most days of the week. As we are all traveling more, parental consent for travel forms and representing your family at the passport agency continue to be mainstays in our business.
-
This year we also got even more active in the community by helping out at the Rescue Mission for Neighborhood Wednesdays and notarizing birth certificate request forms for the homeless so that they can get ID cards from the DMV. We also worked closely with Hospice of Santa Barbara in notarizing Advanced Health Care directives after their successful workshops at senior homes throughout the year.
-
Finally, we are starting a new business with the new year called Santa Barbara Legal Document Service where you can get affordable legal document preparation. Alexis, who is a certificated paralegal and now a Legal Document Assistant (registered in Santa Barbara County ID #60), has started Santa Barbara Legal Document Services and took care of her first client this week. If you have a deed or trust document that needs to be made where you know what you need and do not need legal advice, she can prepare that for you. From there, she can notarize the document and even get it recorded if needed. You’ll hear more about this service as we begin 2023.
