Medicare Set Asides are not required! There is no law that requires telling the government what you are settling for in a third party case or comp. BUT, the feds are working on some new codes!!! I think we are months away from the Code of Federal Regulations making it mandatory that beneficiaries meet future medical treatment obligations under the Medicare Secondary Payer Act (MSP). Stay tuned. . . the days of carriers underpaying or walking away all together from medical treatment awards will come to an end. . .

Injured workers in California, after January 1, 2013, may be entitled to a one-time $5,000 payment under the Return to Work Supplement Program (RTWSP).
