We deal primarily with bail forfeiture law in California, and we have been at the forefront of legislative and judicial efforts to streamline and develop rules that are comprehensive and advantageous for the industry as a whole. The vote on SB 262 has been delayed to the next legislative session. We look forward to using this Time to help educate the public and legislators of the advantages of family-based pre-trial release, and the disastrous effects that government pretrial is having on California.

SB-262 has already passed the Senate and the Assembly Public Safety Committee if signed into law it would set bail at $0 for most offenses.
Also, If the action or proceeding against the arrestee who has been admitted to bail is dismissed, no charges are filed against the arrestee within 60 days of arrest, or the arrestee has made all court appearances the bail agent will be required to return 95% of their premium.

The California Legislature is trying to sidestep the will of the People by proposing legislation to virtually eliminate cash bail mere months after the California's voters resoundingly rejected the same concept. By labeling their legislation as “zero dollar bail” instead of elimination of bail, the legislature is hoping that you don’t notice that they are functionally the same. Counties around the State resoundingly rejected zero dollar bail during the peak of the COVID-19 crises, citing safety concerns as repeat offenders were let go, only to immediately commit more crimes.

Court finds bail Insurance Code of Regulations Title 10 section 2076 unconstitutional. This regulation prohibited bail agents from making arrangements to receive information about people who have been arrested or charged. This regulation was the basis of the arrest of around 31 bail agents in Santa Clara County in 2015.
