USCIS Policy Memorandum PM-602-0199 emphasizes that Adjustment of Status is discretionary and may require some applicants to complete the green card process through consular processing abroad.

Starting May 29, 2026, USCIS will begin enforcing consequences for unpaid Annual Asylum Fees on pending asylum cases.

The Annual Asylum Fee is a new yearly fee that applies each calendar year a Form I-589 asylum application remains pending. Once a case has been pending for about one year, USCIS will send a notice with a 30-day deadline to pay.

If the fee is not paid within 30 days, USCIS may reject the pending asylum application. This can also affect asylum-based work authorization, including pending Form I-765 applications and existing work permits.

It is also important to keep your address updated with USCIS and the Immigration Court, and to check your mail regularly. Missing a notice, hearing, motion, or appeal deadline may lead to serious consequences, including a possible removal order in absentia if you miss a court hearing.

If you have a pending asylum case, review every USCIS notice carefully and act before the deadline.
