In a key win for employers, the California Court of Appeal ruled in Williams v. Alacrity Solutions Group, LLC (bit.ly/4lXWi86) that PAGA plaintiffs must have a timely individual claim to proceed. The plaintiff’s representative PAGA action was dismissed for failing to file a timely PAGA notice, reinforcing that timely individual claims are required. While some courts have disagreed, this decision strengthens employers’ ability to challenge stale PAGA claims.
