This is a great explanation about the DACA court case. The big news was on Monday, Sept 29, the government filed a brief where they proposed starting to process initial DACA applications that have been on pause since 2021. This is good news! But this does not mean that this will start happening now. This is only a proposal. We have to wait for both sides to respond and then Judge Hanen will make a decision. We probably will not have a decision until around October 27, 2025.

The Federal Appeals Court will hear arguments in the DACA case today. This case was originally filed in 2018. "It could take weeks or months for the court to issue a decision. Any ruling is expected to be appealed to the Supreme Court."

A federal appeals court will consider the future of DACA, which has allowed hundreds of thousands of undocumented young people to live and work in the United States.

Great news! President Biden has announced a new program that will benefit immigrants who are married to US Citizens and have been living in the US for at least 10 years. There will also be new options for people with DACA and those who are DACA eligible. We will be receiving more information soon about when we can start applying. Legislation proposed called "Case Backlog and Transparency Act" would impose strict reporting requirements on USCIS and would analyze the backlog’s causes and propose ideas to cut down on the delays. I'm glad that Congress is taking note of how unreasonable the current processing times are for many immigration benefits. Here is some helpful information from United We Dream about yesterday's decision from the 5th Circuit about DACA. In a nutshell: renewals are still being processed but the initial DACA requests are still on hold. The case will go back to the lower court to review President Biden's new DACA rule:

The Fifth Circuit Court has agreed with anti-immigrant Judge Hanen, and has sent the decision back for Hanen to decide on the future of DACA.
