Hurt in a friend's car?

The innocent passenger rule is not only for rideshares. If you were riding with a friend and the car hit something, or someone hit you, you have a claim. As the passenger, you carry no fault for the crash.

If you are in pain afterward, get an attorney involved early to walk you through it. The claim goes to the driver's insurance, which is what that coverage is for.

Save this before your next ride. Send it to someone who was a passenger and thinks they have no claim. Comment CRASH and we will send you our free post-crash guide, The First 72 Hours.

What is my case worth?

We start with experience. Cases that have been tried give a general range, and after thousands of cases we know how a spine injury compares with a broken arm, or a torn meniscus with a brain injury. The facts of each case move the number from there.

Then there is the county. Juries in Los Angeles County have tended to award more than juries in more conservative counties like Orange County, especially for general damages, the harm to your life beyond the bills. Where a case can be filed may change what it is worth.

Save this before anyone quotes you a number. Send it to someone wondering if their offer is fair. Comment DECODER and we will send you our free guide to what the adjuster is actually doing.

Repair and deduct, the legal way.

California Civil Code 1942 lets a tenant pay for a repair the landlord ignored and take the cost off the next rent. It covers what makes a unit unlivable: heat, hot water, plumbing, electrical, a roof that keeps rain out.

The rules matter. Ask for the repair in writing first and give the landlord a reasonable time, which the law presumes is thirty days. The repair can cost no more than one month's rent, you can use it twice in any twelve months, and it does not cover damage you caused. Keep the notice, the photos, the invoice and the math, and send the landlord a copy with the reduced rent.

Civil Code 1942.5 protects you afterward. For 180 days, a landlord cannot raise the rent, cut services or move to evict because you used it, as long as you are current on rent.

Repair and deduct can vary case by case. This post is general information, not legal advice.

Save this before you pay for a repair. Send it to a neighbor still waiting on the landlord. Comment GUIDE and we will send you our free LA Renter's Rights Guide.

Do not take that call.

If you have been in a crash in LA and the insurance company is calling, talk to an attorney first. Adjusters handle crashes all day, they have the software that tells them what a case is worth, and a fast first offer is how they limit what they pay later.

An early offer usually means they think the crash is worse than you do.

Take a beat. Call an attorney, even if you do not hire one, and get a read on what the case might be worth. Then decide whether to accept it or bring in a lawyer.

Save this for the day the adjuster calls. Send it to someone who just got a settlement offer. Comment DECODER and we will send you our free guide to what the adjuster is actually doing.

What a lawyer actually costs after a crash.

Most injury lawyers in California work on contingency. The fee is a percentage of what the case recovers, paid out of the recovery, and only if there is one. That is how someone hurt, out of work and short on savings can hire a firm the first week.

California requires the agreement in writing. It has to state the percentage, how costs affect the fee and your recovery, and that the fee is not set by law and can be negotiated. At the end, a closing statement shows the gross amount, the fee, each cost, every lien, and what is left for you.

Costs are a separate line from the fee. At our firm, if we spend money on investigators and experts and the case does not come through, we absorb that.

Save this before you sign anything. Send it to someone who thinks they cannot afford a lawyer. Comment CHECKLIST and we will send you our free post-crash guide, The First 72 Hours.

Number one in California.

TopVerdict.com ranked one of our settlements the top result in the state for 2025 in its category, motorcycle v. premises accidents. Ryan Daneshrad handled the case.

A motorcycle case against a property owner is two hard cases in one. The rider has to show the hazard was there and that the owner should have dealt with it, while the other side argues the bike was the problem. Those cases get turned away a lot. This one did not.

We do not post rankings often. Save this if you ride. Send it to someone who was told a premises case is not worth pursuing.

Rent controlled? Know the rules.

Most leases in California run twelve months, and the rent is locked for that year. In a rent-controlled unit, which in Los Angeles is almost any building built before 1979, the lease ending turns you into a month-to-month tenant. That tenancy cannot be ended by the landlord without just cause. It can only be ended by you.

So when the year lapses, the rent starts jumping and the landlord is trying to move you out, call a city investigator or an attorney and find out whether the unit is rent controlled. If it is, there is no way to remove you without just cause. A new lease for another year at well above your last rent is the same red flag.

These rules are strict against landlords, and strictest inside the Rent Stabilization Ordinance.

Save this before your lease is up. Send it to someone being told to sign or leave. Comment TENANT and we will send you our free LA Renter's Rights Guide.

The car gets handled first. The injury does not.

A crash creates two claims on different clocks. Property damage resolves in days or weeks. The injury claim waits for treatment to finish. Separating them is normal, and it is how the car gets fixed while the injury is still being measured.

The at-fault driver's insurer owes the repair, the rental and the loss in value once it accepts fault. If that takes weeks, your own collision coverage pays now and collects the deductible back later. Ask for the rental on the first call. On a total loss, the valuation is a negotiation: request the report, send your own comparables, and ask for each adjustment in writing. A repaired car is worth less than it was, and California lets you claim that drop from the at-fault driver's insurer.

Then read the release. It should say property damage only. If it mentions bodily injury, do not sign it.

Save this for the week after a crash. Send it to someone whose car is sitting at a tow yard. Comment CHECKLIST and we will send you our free post-crash guide, The First 72 Hours.

Send the fourth request.

The complaints we see most are the ones the landlord answered with a promise to send someone out and then nobody came, or the ones they ignored altogether. In those situations the details are everything.

List every problem, not just the loudest one. If the heat is out and there is also a leak, put both in the same message. When the response is a generic promise and no one shows up, send the follow-up: it has been a week, two weeks, three weeks, the issue is still here, winter is coming, the smoke detector is still beeping. Each one documents the landlord's failure to respond.

That record is what these cases turn on.

Save this if you have been waiting on a repair. Send it to the friend whose landlord keeps saying someone is coming. Comment GUIDE and we will send you our free LA Renter's Rights Guide.

The police report decides less than you think.

It holds what each driver said, what the witnesses said, where the cars ended up, and the officer's read of the primary collision factor. That read is an opinion, written by someone who did not see the crash. Insurers lean on it because it is the first document in the file. It does not bind them, a court, or you.

Reports get corrected more often than people think. A misheard statement, a diagram with the cars in the wrong lanes, a witness the officer never reached. Ask the agency for a supplemental report and bring what the officer did not have.

Get the report number before you leave the scene. If police never came, file a counter report, and California requires an SR-1 to the DMV within ten days when anyone was hurt or the damage passed a thousand dollars.

Save this before you need it. Send it to someone who was told the report says it was their fault. Comment CHECKLIST and we will send you our free post-crash guide, The First 72 Hours.
