El presidente Biden anuncio un nuevo programa para conjugues de ciudadanos americanos casados legalmente a partir de junio 17, 2024, que han estado presente por diez años a partir de junio 17, 2024, que tienen buena conducta moral, y que no son inadmisibles por otro motivo más que por haber entrado sin documentación.

Todavía NO está en efecto este programa, pero pueden hacer una consulta gratuita para determinar si son elegibles basado en la información que tenemos, llamando a Navarro Law Group, APC a 818-365-6777.

Por favor no traten de solicitar este beneficio hasta que se formalicen los reglamentos y USCIS indique que está recibiendo solicitudes.

⚖️ On July 16, 2021, a Federal District Court in Texas issued a ruling in Texas v. United States limiting the DACA policy and declaring it unlawful. More analysis will come as we learn about forthcoming USCIS operational guidance about DACA but for now here are a few key points about the recent decision. ⬇️

➡️ What does this decision mean for DACA recipients?
- Current DACA cases remain valid. People who currently have DACA keep their DACA protection and work permit. Nothing has changed with already-approved DACA cases.
- DACA renewals continue. People who have DACA now or had DACA in the past are still eligible to renew their case. Pending renewals will be processed normally.

➡️ What does this mean for DACA-eligible individuals who have applied for initial DACA?
- First-time DACA applications are on hold.
- No new DACA application will be approved at this time. The decision has blocked USCIS from approving new DACA cases. This means that those who have submitted an initial request (i.e., those that never had DACA) and have not received an approval from USCIS will have their application held. This applies to all initial requests that were not approved prior to July 16, 2021.

➡️ What about people who were preparing to file their first request?
- The judge’s decision prohibits USCIS from approving any first-time DACA applications at this time. USCIS can accept initial DACA applications but will not issue any decision on them.
- It is unclear at this point whether there is any benefit to requesting DACA for the first time now and having an application pending. More guidance will come soon.

➡️ What if someone was just granted DACA for the first time?
- If you were recently granted DACA for the first time, your DACA will remain valid.
- You should plan to renew your DACA in the future and in the meantime stay informed about changes and updates to the DACA policy.

➡️ What does the decision mean for DACA overall?
- We will likely hear more about DACA soon – both from USCIS and from the Biden administration directly.
- People will continue to fight to protect DACA and the legal case will continue in the courts.
- It is important to stay informed and to speak with a trusted legal service provider about your specific case!

🚨 BREAKING: A federal judge’s ruling today declared the program unlawful in a case led by Texas Attorney General, Ken Paxton and joined by 9 states.

While the decision does not affect current recipients and their ability to renew their DACA cases it does block the government from approving new applications for first-time applicants.
