A living trust is one of the most misunderstood estate planning tools.

Think of it like a set of instructions for what happens to your assets while you are alive and after you pass away.

It can help your loved ones know who is in charge what should happen next and how certain assets should be handled.

A trust is not just for the ultra wealthy. For many families it can be a practical way to create clarity privacy and peace of mind.

Choosing the right estate planning attorney matters because a trust only works the way it should when the plan is built correctly.

“What happens to my child… if something happens to me—and we might not even stay in this country?”

A family recently asked me this, and it stayed with me.

They live here in California.
Their daughter is doing well, building her life.
Their son has significant special needs and depends on Medi-Cal and regional center support.

But their future isn’t certain.

They may stay in the U.S…
Or they may return to China, where they’ve already found a care community for their son.

And that changes everything.

Because planning for a child with special needs is already complex…

But when you add **different countries, different systems, and an uncertain future**—most families don’t even know where to start.

Together, we created a plan that:

✔ Protects their son’s benefits here in the U.S.
✔ Allows financial support if he later lives abroad
✔ Keeps their family out of court
✔ Protects their daughter’s inheritance
✔ Plans for “what ifs” most people never think about

By the end, they didn’t just have documents.

They had peace of mind.

Because no matter where life takes them…
their son will be cared for.

💛

“Am I missing something?”
“Will my child be okay long-term?”

Sometimes we forget what really sticks with our kids.
They won’t remember how clean the house was, how “put together” you looked, or how fancy their toys were.
They will remember how it felt to be loved, safe, and wanted.
If today feels messy or “not enough,” this is your reminder:
you are doing better than you think. 💛

A complete estate plan is so much more than a will 🛑

A will is important but by itself it may not be enough to keep your family out of court or make sure the right people have authority when they need it

In California a complete estate plan often includes a trust to help manage and transfer assets

A will to name guardians for minor children and cover anything not placed in the trust

A financial power of attorney so someone you trust can handle money matters if you are incapacitated

A health care directive so someone can make medical decisions if you cannot speak for yourself

And guardian nominations if you have children under 18

The goal is not just to have documents

The goal is to make sure your family knows who is in charge what happens next and how to avoid unnecessary delays expenses and stress

Estate planning is not just paperwork

It is protection for your children your home your finances and the people you love most

A trust sitting in a drawer with your home still in your personal name doesn’t keep your family out of court. The magic is in how the home is actually titled and how often you update your plan. Education only, not legal advice.

If your child has special needs turning 18 can change more than most families realize 🛑

Once your child becomes a legal adult you may no longer automatically have the same ability to access information make decisions or help manage important parts of their life

That can include medical care
Educational records
Financial accounts
Government benefits
Legal decisions
And long term support planning

Even if you have been the person handling everything for years the law may treat your child as an adult once they turn 18

This is why planning ahead matters

Some families may need powers of attorney
Some may need supported decision making
Some may need a limited conservatorship
Some may need a special needs trust
And many families need to review how inheritances life insurance and beneficiary designations could affect benefits

The biggest mistake is waiting until there is an emergency to figure it out

Planning before your child turns 18 gives your family more clarity more options and more peace of mind

Estate planning does not have to be complicated 🛑

At its core estate planning is simply a plan for the people you love

It explains who should care for your children if something happens to you
Who should make decisions for you if you are too sick or injured to make them yourself
Who receives your home money accounts life insurance and belongings
And who is responsible for making sure your wishes are followed

Without a plan your family may be forced into court during an already painful and stressful time

That can mean delays confusion unnecessary expenses and decisions being made by someone who does not know your family the way you do

Estate planning is not about being rich

It is about making sure the people you love are protected and the people you trust are the ones in charge

“You can do hard things no matter what.”
Whatever your “uphill” looks like right now—parenting, work, special‑needs advocacy, or just getting through the week—you’re allowed to go slow, wobble, take breaks, and still be proud of yourself for staying on the bike.
You don’t have to climb perfectly. You just have to keep moving in the direction that matters to you and your family. 💛
