The California Supreme Court held in Fluor Corporation v. The Superior Court of Orange County that Insurance Code section 520 – which precludes an insurer from refusing to honor an insured’s assignment of the right to invoke defense or indemnification coverage for personal injury or property damage resulting in loss occurring within the time limits of the policy – applies to third party liability insurance and applies regardless of whether the insurer has given its consent.
