If you’re considering asking for a divorce after 50, you aren’t alone. The divorce rate after the age of 50 has doubled since 1990 and has tripled for people over 65. Couples who once felt they had to stay together for their children or to meet traditional expectations now feel able to leave unhappy marriages. The trend is so persistent, it has earned its own name, “Gray Divorce.”

Leaving an unsatisfied marriage can be freeing; however, pursuing a divorce after 50 comes with its own unique challenges; a gray divorce tends to be more complex than a divorce between younger couples.

Did you know that there are things you cannot do once your divorce has been filed? Here is a summary of what you CANNOT do once your divorce is filed, as listed on the Summons. Starting immediately, you and your spouse are restrained from:

1. Removing the minor children of the parties from the state without the prior consent of the other party;

2. Cashing, borrowing against, canceling, transferring, disposing of, or changing the beneficiaries of any insurance, including life, health, automobile, and disability, held for your spouse or the children;

3. Transferring, encumbering, hypothecating, concealing, or in any way disposing of any property, real or personal, whether community, quasi-community, or separate, without the written consent of the other party; and

4. Changing estate planning documents. There are some things you can and cannot do, so consult with an attorney before modifying or revoking anything.

When you need to attend a family court session, you’ll probably want to know if you can do the session in person or perhaps over the phone.

Generally, you do have to be in person for your family court session; however, there are a couple of circumstances where you can make arrangements to do your session via phone.

For example, if you are out of town during your session date, or if you live out of town and can't make it to your family court session, you could try to make arrangements in advance for your counseling appointment.

Navigating tax changes after a divorce with real estate involved can be a tricky process. Taxes are always in flux and can change with the divorce proceedings. It's important to ensure you’re up-to-date with the current tax laws and how they may affect the division of assets.

* The first step is to research all local, state, and federal taxes that could come into play. This includes income taxes, property taxes, real estate transfer taxes, and more. Make sure you understand all possible implications of a divorce settlement on your taxes.

* You should also explore any tax strategies that are available in order to minimize your overall tax burden as much as possible. For example, if one party keeps ownership of the home but transfers it for less than market value, then this could result in capital gains for the other party—something to be aware of if trying to balance out equitable divisions in an unequal asset situation.

* It's wise to seek professional help when dealing with tax changes after a divorce involving real estate; an experienced financial advisor or accountant can assist you in finding optimal solutions that will benefit both parties while ensuring compliance with all applicable tax laws.
