🚫💉 US Statutes regarding Vaccinations and Waivers for Immigrants

US required vaccinations are an important public health policy to protect society. All intending immigrants who want to become US permanent resident green card holders are required to be vaccinated. But there are cases when vaccinations are not appropriate:

▪️Not age appropriate
▪️Insufficient time interval between doses
▪️Contraindicated based on patient conditions
▪️Not routinely available in the foreign country
▪️Not fall (flu) season
▪️Known chronic Hepatitis B virus infection
▪️Religious Objections
▪️Moral Objections

🆓 In the case of religious or moral objections to certain vaccinations, the foreign immigrant needs to appear before the law and prove their case.

A form I-601 waiver must be filed with the USCIS at the appropriate address, along with supporting documentation and argument regarding the waiver.

✅ A compelling I-601 vaccination waiver needs a good lawyer. We can help you!

It is possible to expedite a visitor visa application or any other immigration application for good cause, normally based on humanitarian concerns. Caring for newborn twins sounds problematic since an American can be hired to assist your wife. Grandmothers visiting the US are not allowed to work. So, there must be an alternative basis for expedite that identifies a humanitarian concern.

All foreigners applying for US immigration benefits must generally have COVID vaccinations. An exemption is possible for those foreigners who have a sincerely held religious or moral objection to vaccinations.

Sincerely held beliefs must be based in scripture or other documentation showing that the belief is part of the religious or moral dogma. Objections that are not anchored in a belief system is insufficient to justify a waiver.

On July 16, 2019, the U.S. Department of Justice (DOJ) and U.S. Department of Homeland Security (DHS) published a joint rule in the Federal Register attempting to limit access to asylum for individuals who traveled through a third country on their way to the United States.

With limited exceptions, the new rule barred asylum for any person who,🧐

“enters or attempts to enter the United States across the southern border, but who did not apply for protection from persecution or torture where it was available in at least one third country outside the alien’s country of citizenship, nationality, or last lawful habitual residence through which he or she transited en route to the United States.”✒

On December 2, 2020, the Ninth Circuit Court of Appeals upheld preliminary injunctions issued against DHS’s Public Charge Rule. ✒️ In its order, the panel majority vacated a nationwide injunction issued by the Eastern District of Washington. Consequently, it remains unclear whether the Eastern District of Washington will need to revisit its order to address the scope of relief.🧐

USCIS has not decided how it will implement the state-specific injunction. The agency will likely move for an immediate stay of the injunction as it has done in the past prior to issuing further guidance.
