With the hustle bustle of the new year, we have not been posting wins at all yet this year, so time to get back on top of it! This was a great win both in Court and at the DMV. Our client was driving the wrong way (westbound in an eastbound lane) without her headlights on late at night. Fortunately there was no other traffic around and she was stopped as soon as the violation was noted. She blew a .088% and .087% on the Portable Breath Test in the field and then blew a .086% and a .089% after she was arrested down at the station. Although the underlying facts of the case made it difficult, her breath alcohol levels were relatively low. We were able to get the DUI charges dismissed in Court in exchange to a plea to a lesser offense and then we fought at the DMV after multiple hearings over nearly a year and many months after the court case settled....in the end the DMV agreed that they did not have the necessary evidence to support a license suspension and we WON! No license suspension at all for our client and she can finally move on with her life!

Ok, Ok, we had to squeeze in just one more DMV victory before the New Year and just in the nick of time! Our client was stopped at the Border where he was detained by Border Patrol and later arrested by CHP where he blew over a .20% on a PAS device and then blew .18%/.17% on an evidentiary breath machine after he was arrested. Result? We win! A holiday present for our client and always a cause to celebrate when DMV does the right thing based on the evidence or in this case the lack therof! Squeezing at least 1 more DMV Win before next year! This was a .10/.08 PAS; .08/.08 evidential breath test. We had her DUI charges dismissed in Court and then fought the DMV for almost 2 years with multiple expert witnesses and finally the DMV agreed that her alcohol level could have just as likely been .07 as it could have been .08% and tie goes to the Licensee, not the DMV (which does not always happen but it did here). Very happy ending for a client who deserved it and will never consume alcohol and drink a car again.
