Understanding Utilization Review & IMR when fighting a medical care denial in workers' comp in San Diego

For injured workers already dealing with pain, lost wages, and uncertainty, having recommended medical treatment blocked can feel confusing and frustrating. 😟 You run into the term Utilization Review (UR) when you just want to get better, but a doctor you've never met says "No" to the care your primary doctor requested.

The Reality: In California, a UR denial isn't the final word. If a treatment request is denied or modified, the primary method to challenge that decision is Independent Medical Review (IMR).

Understanding the UR process helps clarify who is making medical decisions at each stage and what options remain after a denial.

⚖️ California workers’ compensation benefit rates increased on January 1, 2026, and many injured workers may not realize their weekly checks could be higher.

If you were hurt on the job in 2026, your disability benefits may have increased due to a rise in the State Average Weekly Wage (SAWW).

Here’s what changed:
• Maximum TTD/PTD: $1,764.11 per week
• Minimum TTD/PTD: $264.61 per week

These updated rates apply to injuries occurring on or after January 1, 2026. Unfortunately, insurance companies don’t always update payments automatically.

If you’re currently receiving workers’ comp benefits, it’s important to make sure your checks reflect the correct rate.

Thomas DeBenedetto has represented injured workers in San Diego since 1992 and focuses on helping clients understand their benefits under California law.

Permanent disability does NOT mean permanent income.
Many injured workers don’t find out until it’s too late.

If you’ve reached Maximum Medical Improvement (MMI), your benefits are no longer about recovery — they’re about ratings, caps, and payment schedules set by California law.

This infographic explains:
- How disability ratings affect your money
- Why payments are often lower than expected
- When lump-sum settlements may apply
- How disputes can drastically change your outcome

A few percentage points in your rating can cost you tens or hundreds of thousands of dollars over time.

Why Workers’ Comp Claims Get Denied — and How to Get Back on Track

A denied workers’ compensation claim feels overwhelming — but many denials can happen for reasons outside the worker’s control:

• Late reporting
• Insufficient medical documentation
• Employer disputes
• Pre-existing conditions
• Inconsistent statements
• Cost-driven denials

Receiving a denial is not the end. California’s workers’ compensation system includes an appeal process that can still lead to full benefits.

Insurance companies will often offer little or nothing until the right evidence is gathered and the case is pushed forward by having an experienced work injury attorney who knows how to fight these denials.

Injured on the job. Unable to walk. Denied benefits. This is how his workers’ comp case began.

$2.1 Million Settlement — Warehouse & Delivery Worker

A San Diego warehouse and delivery worker suffered a catastrophic leg injury that left him unable to walk safely or perform daily tasks without help. Even after multiple surgeons recommended in-home support, the workers’ compensation system denied the care he urgently needed.

When the denial continued, San Diego workers’ compensation attorney Thomas DeBenedetto took over the case. He built the medical and psychological evidence showing why structured in-home care was essential for the worker’s safety, recovery, and independence.

Through focused litigation and detailed documentation, Thomas overturned the denial and secured approval for home health services — ultimately obtaining a $2.1 million settlement that ensures long-term medical and financial stability.

Serious work injury? Can’t work and bills are piling up?

California’s temporary disability (TD) benefits — also called lost wages — replace about ⅔ of your weekly pay (tax-free) while you recover.

2025–2026 rates:
💵 Min $252.03/week 💵 Max $1,680.29/week

But insurance carriers often delay or deny TD payments, leaving injured workers fighting for the benefits they already deserve.

Back injuries are among the leading causes of missed work for California employees—responsible for over 38% of work-related musculoskeletal disorder cases nationwide.

Yet these claims are also among the most disputed.

Insurance companies often:
• Blame your pain on a “pre-existing condition”
• Push you back to work before you’re ready
• Downplay your symptoms with insurance-paid medical exams
• Offer low settlements that don’t cover your future care

If you’re dealing with any of this, understand your rights and the benefits available for a work-related back injury.
