You should be familiar with whether you're in a community property state or an equitable distribution state!

This has a central role in determining the following:

- how you want your businesses set up & ran,

- how you want to go about creating an estate plan for your family,

- whether you want to acquire property jointly or separately, and

-how you want to draft your prenup, postnup, or cohab agreement.

Only 9 states are community property states.

38 states are equitable distribution states.

3 states allow for the couple to choose. Those states have the (*) next to them: AK, SD, TN

I've been 🗣 chatting (AKA advocating) about prenups quite a bit and here's a quick snippet of a comment I left, to provide clarification on characterizing property.

This was made speaking specifically about California - a community property state.

🌟Property acquired prior to a marriage is separate property & will remain that person's separate property (some exceptions).

🌟Property acquired during a marriage is community property. That means the money & income you make during a marriage (ie from employment) is community.

🌟Where there ends up being issues is when community property (aka your income💰) starts going towards your separate property. Paying down the mortgage or expenses, making renovations,etc. 🏠🚗

🌟Now, your separate property has community ties to it. That can be dangerous for several reasons, not only considering possibly divorcing or separating.

🌟Prenup are used so you, courts, & third parties know exactly how to treat all assets and debts.

😖 Bringing up the topic of a prenuptial or postnuptial agreement can be hard, uncomfortable, and tricky. 😩 Media has distorted the image of prenups and postnups to where most automatically assume the worst. 😡

Here are 4 tips to help:
1️⃣ Be Sensitive & Pick an Ideal Time & Place.

Most who are being confronted with the thought of a prenup/postnup will likely go on the defense immediately. Do not🛑 bring up the conversation during or after an argument. Make sure the atmosphere is a safe one – create a safe space.💜 Have the conversation in private. Be emotionally supportive during the conversation. Don’t bombard your partner with this conversation. If they need time to process & think – provide them that time do so.

2️⃣Make the Conversation About “We”.

Using “I” and “You” statements tend to pit individuals against each other. Remember, this is a marriage – a union. 💏The prenup/postnup is to protect and strengthen the marriage.💪🏾 Using “we” statements will allow both partners to feel like they’re in it together. I'll help you practice.

3️⃣ Remove the Primary Focus of Divorce.

Although prenups/postnups are beneficial in the event of divorce, it is not the only reason NOR is it the primary reason. ❌People already assume that’s the only reason they’re necessary, and it’s not. However, it is OK to be vulnerable & communicate fears of divorce, especially if this is not either party’s first marriage.🥺

4️⃣Focus on Other Benefits the Prenup/Postnup Will Provide.

Focus on how it’s going to create a peace of mind. ☮Focus on how it’s going to allow you both to successfully do estate planning. Focus on how it’s going to benefit your current or future children. Focus on how it will protect you both during a financial crisis.
