A client's mom made Mr. Duarte this Fiesta shirt.

She didn't order it online or see something at a store and buy it for him. She made this for him.

When you help someone on a criminal defense case you're not just handling a case.

You're helping someone in their worst moment. A family is scared. And a mom just wants her son to be okay.

We answer their questions, we talk them through their fears, and we tell them the truth about what could happen.

That's exactly what Mr. Duarte did with this client and his mom.

And when he resolved this felony case in a favorable way this gift showed up at our office this week.

Sometimes you don't just get a favorable result. Sometimes you have a client and their family who make you something special like this. It's a part of the job our office loves.

The holidays are here and we are thankful to have celebrated this week with our team and close friends.

Not even a broken hand could stop attorney Demetrio Duarte from arguing against prosecutorial vindictiveness and violation of double jeopardy protections today. Here’s what happened.

In the first trial our client was charged with continuous sexual abuse of a child and indecency with a child. We won the trial.

33 days later the District Attorney indicted our client again for indecency with the same child.

Today attorney Duarte argued this issue in front of the Court of Appeals in Austin, Texas. This is important to all citizens. Justice must always be applied evenly. And our office will fight for our clients in any court when it is necessary.

Recently our office had 23 heirs in one estate. 2 in wheelchairs. Another with a cane. Imagine herding this large of a group through a courthouse ... without a plan.

It could have been a logistical nightmare and a headache for a lot of lawyers in the courthouse. But it wasn’t, because our office was prepared. We know how important it is to know your witness/witnesses needs.

Our office knew we had two witnesses in wheelchairs. If we didn’t have transportation planned the whole morning would have been derailed before testimony began.

This is something we've seen lawyers forget to consider until it’s too late and it can create problems.

It's why our office planned:

- courthouse access into the building,
- knew where the elevators were,
- and coordinated accommodations at the witness stand.

When a law firm handles these kinds of details, especially with grieving families who lost a loved one in an 18-wheeler crash, this preparation reduces their courtroom stress. We know preparation prevents courthouse chaos.

But it could have been a much more different experience had we not been prepared.

When hiring a law firm look for one with experience beyond just the years. Look for a law firm that understands details like this matter to you and your family when you are going through something difficult.

Our client is innocent, yet he sits in jail because of an allegation of aggravated sexual assault. If we don't win his case he could be deported and his whole life changes.

Criminal defense lawyers are seeing more and more of these kinds of situations. And we have to fight them.

In this case our client is a legal resident alien who has been in the United States for 20 years. If he posts bond immigration will pick him up and he may be deported. There is no choice, he has to stay in jail.

Cases like this need evidence to corroborate the story:

- It looks suspicious, because ______.
- Someone caught them in a room.
- Someone saw my client running out the back door of the house.

Something that helps to validate where and when the alleged incident took place and occurred.

We don't have that here in this case. Not a shred of evidence, just an allegation. A he said, she said.

There are a lot innocent people out there. And right now allegations like this can be career ending and status threatening for anyone who is a legal resident alien.

If our client gets convicted of this, or of any lesser included offense, he still gets deported.

This is a serious, life changing case for him. He has to win at all costs. We have to fight this for him.

So now we prepare for trial. We fight. And we announce ready for trial and are prepared, because we don't forget about our client who sits in jail until that day arrives.

Congratulations to attorney Tim Molina!

A head-on car accident led to an improvident indictment of a young man for Aggravated Assault with a Deadly Weapon. You can run over someone intentionally and it is a crime.

But accidents are not crimes where we send people to prison.

Molina properly evaluated the case and went to trial.

The jury found driving over the center stripe was Deadly Conduct and convicted him of this as a misdemeanor offense.

Our client is now on a one-year probation term and not sitting in prison for ten years.

Thankfully our client was lucky to have a lawyer who knows WHEN and HOW to fight in the courtroom. And that decision saved him from the years in prison he was faced with for this accident.
