An open letter to Skadden Arps and Paul Weiss:
As a former lawyer and relatively decent human being, I am beyond disappointed that my colleagues in the law have chosen to align themselves with the creeping authoritarianism of the Trump regime. The decisions by Skadden, Arps, Slate, Meagher & Flom LLP and Paul, Weiss, Rifkind, Wharton & Garrison LLP to provide $100 million and $40 million respectively in pro bono legal services – at the direct request of a self-proclaimed billionaire – are not only ethically disturbing but historically familiar.
Let us not be naïve about what this moment represents. Authoritarian regimes have long understood the power of co-opting lawyers to provide a veneer of legitimacy to their actions. In N**i Germany, major law firms facilitated the transfer of Jewish businesses and normalized the legal infrastructure of oppression. In Hungary, lawyers sympathetic to Viktor Orbán were appointed to the judiciary and used legal tools to erode civil liberties. The playbook is well-established: when powerful regimes seek to dismantle democratic norms, they often begin by bending the legal profession to their will.
By acquiescing to the Trump administration’s pressure – agreeing to abandon diversity initiatives and redirect tens of millions in legal expertise toward an immensely troubling political agenda – your firms have not only normalized this coercion but rewarded it. You have set a chilling precedent: that the world’s most powerful lawyers can be bought off with influence and spared scrutiny if they simply play along.
This is not merely about political affiliation. It is about professional integrity and the solemn obligations of the legal oath. When attorneys are sworn into the bar, we promise – with slightly different words depending on the jurisdiction – to uphold the law, to defend the U.S. Constitution, and to remain loyal to the constitution of our home state. That oath is not contingent on the client’s wealth or ideology. It is certainly not an invitation to trade principles for proximity to power. Yet the attorneys in power at Paul Weiss and Skadden, perhaps eager to preserve their social standing or curry favor with political elites, have turned their backs on that promise.
Meanwhile, millions of Americans struggle to find representation in housing court, immigration proceedings, child custody disputes, and criminal defense. Legal deserts span entire counties. And yet, two of the most powerful firms in the world have chosen to funnel $140 million in elite legal services toward a man who has the means to pay – and a long history of undermining the very Constitution we are sworn to uphold.
I write not in anger alone, but in grief for what the profession is becoming.
To the attorneys within these firms: you have a choice. You are not powerless cogs in a vast machine. You are members of a noble profession, and you can object. You can speak up. You can demand accountability from your leaders and refuse to lend your talents to causes that violate the spirit of justice. You can also quit. You are hireable elsewhere.
To the clients of these firms: you are not passive participants in this disgrace. If you continue to retain Skadden or Paul Weiss, you are subsidizing their choice to prioritize political expedience over principle. You are lending your dollars and credibility to a system that now serves power, not justice. Fire them. Withdraw your business. There are countless capable firms and lawyers who do not compromise the rule of law for access or advantage. If you believe in democracy, in equality, in basic decency – choose counsel who does too.
To the law students and young lawyers watching this unfold: let this be a lesson in where prestige without principle leads. Choose your mentors wisely. Choose your employers wisely. Choose your legacy wisely.
If the American legal system is to mean anything in the years to come – if its professionals are to claim even a shred of moral authority in our democracy’s defense – we must be willing to call out our own. We must be willing to say: Not in our name.
— A former lawyer and a citizen still bound by principle

A federal judge in Austin on Thursday blocked Texas state officials from implementing a sweeping immigration law that would have allowed them to arrest, jail and prosecute migrants who cross into the U.S. illegally.

The Justice Department and the American Civil Liberties Union had challenged the law known as SB4, which was set to take effect on Tuesday, March 5.

In a 114-page order, Judge David Ezra of the U.S. District Court for the Western District of Texas granted the challengers' request for a preliminary injunction preventing Texas officials from enforcing the state law.

DHS Implements New Processes for Cubans, Haitians, and Nicaraguans and Eliminates Cap for Venezuelans
Release Date
01/06/2023
On Jan. 5, 2023, the Department of Homeland Security (DHS) announced a safe and lawful way for qualifying Cubans, Haitians, and Nicaraguans with U.S.-based supporters to travel by air to and temporarily reside in the United States. Individuals arriving under this new process may also apply for work authorization. DHS also announced elimination of the numerical cap for a similar process for Venezuelans announced earlier this year.

This process will provide a lawful and streamlined way for qualifying nationals of Cuba, Haiti, and Nicaragua who are outside the United States and lacking U.S. entry documents to come to the United States. Through a fully online process, individuals can be considered, on a case-by-case basis, for advance authorization to travel to the United States and seek a temporary period of parole for up to two years, provided that they:

Have a supporter in the United States who will provide financial and other support;
Undergo and clear robust security vetting;
Meet other eligibility criteria; and
Warrant a favorable exercise of discretion.
DHS will begin implementing these new processes for Cubans, Haitians, and Nicaraguans on Jan. 6, 2023. For additional information on the process and eligibility requirements, please see the Processes for Cubans, Haitians, Nicaraguans, and Venezuelans page.

DHS strongly encourages Cubans, Haitians, Nicaraguans, and Venezuelans seeking entry in the U.S. who do not have and are not eligible for a visa to instead seek entry via this process, as this will be the safest and most effective way to pursue a temporary stay in the United States. Individuals complete the process electronically and should not approach the border to access this process.

Effective immediately, U.S.-based individuals may submit Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, on behalf of named nationals of Cuba, Haiti, and Nicaragua to come to the United States. We are also continuing the process with respect to Venezuelans.
