It is a crime to possess illegal drugs and the punishment can range from a Class C Misdemeanor to a 1st Degree Felony. While Texas has become more progressive over the years and even passed House Bill 1325 (Consumable H**p Bill), Ma*****na is still illegal. It is illegal to possess the leaf, as well as in the concentrated form of oils. If you are caught with it on your person you could be looking at a criminal charge. While local municipalities may have removed some of the punishments for possessing ma*****na, State law still makes it illegal and punishable.
As well, the Texas Health and Safety Code Section 481.102 lists the Penalty Group 1 Drugs which could lead to Felony charges.
