Taking on the giants!

Our team, led by Partner Jennifer A. Neal, Attorney at Law, Associates Julie Matsen and Jeasette Berrios-Martinez, and Capital Partner Frank Guerra are working with JCA Law to protect children of Texas from social media giants.

Harlandale School District is fed up with the addictive nature of social media. The major social media platforms Instagram, TikTok, Facebook, Snapchat, and YouTube prey on young and impressionable youth exposing them to hazardous content, causing an increase in social-emotional issues. The students of their community are their priority, and they are tired of seeing students suffer.

The influence of these social media giants has gone unchecked long enough. Harlandale and our firm are sending a clear message: the safety and mental health of Texas children come first.

Rideshares are supposed to be a safe alternative to driving. The rider enters the vehicle under the assumption that the driver is not impaired and will drive cautiously, but that does not always happen.

Our client was a backseat passenger in a rideshare vehicle when the driver pulled out from a stop sign into cross traffic causing an accident. The driver was functioning on less than an adequate amount of sleep as there was evidence that he drove until after 2 am the previous shift and began driving again at 7 am that same day up until 6 pm when the crash occurred. On top of the sleep deprivation impairment from the driver, he also failed to ensure that our client was properly belted in before departing which resulted in our client experiencing head and neck injuries from the accident.

They immersed themselves in all the difficult to navigate driver policies for rideshares and built a strong case foundation for our client. After a three week trial, the jury returned a verdict that acknowledges the suffering our clients were put through at the hands of a subsidiary of Hunt Military Communities—one of a handful of corporations that manage all privatized on-base housing for our military. The condition of the homes these companies expect our service members’ families to live in while their loved ones serve our country is atrocious. They need to do better. Congress has demanded they do better. We will continue to litigate these claims until these landlords do what is right.

June's court proceedings are expected to be the first of many such trials involving Hunt and families complaining of issues within the company's homes.

Holding the transportation industry accountable is what I do. Reach out if I may be of service.

Some trucking companies try to avoid liability for negligent driving by contracting with independent truck drivers rather than hiring drivers as employees. The worst companies think this relieves them of the duty to ensure their drivers have acceptable driving histories and follow safety regulations.

In this case, a contracted driver on his way to a mechanic slammed into the rear of our clients while they were stopped at a stoplight. The trucking company claimed it was not liable for its contractor driver because he was not hauling a load for them at the time of the crash. Shockingly, the company also claimed that driving a loaded 18-wheeler while a check engine light is illuminated is not an unsafe practice.

Our attorneys Jennifer Neal, Mike Murray, and Chloe Shrode, along with their team showed this bad company that attempting to skirt its duties to the public is unacceptable and our firm will do whatever it takes to ensure these companies do not get away with this behavior.

Put your phones down when you drive, folks.

There are three types of distracted driving – visual (taking your eyes off the road), manual (taking your hands off the wheel), and cognitive (taking your mind off driving). NHTSA statistics show a significant increase in the likelihood of injury or death due to vehicle collisions when a driver is distracted. Our client was a victim of a distracted driver which resulted in significant injuries.

The defendant driver, who has a history of bad driving, failed to see the car in from of him which resulted in a rear-end collision. Our team of attorneys, Rebecca Page, Jennifer Neal, and Lance Kimbro, along with their team protected our client’s rights and made sure that justice was delivered.

It is important to hold companies accountable for hiring bad drivers, especially when they are behind the wheel of a large commercial vehicle. Our team at Watts Guerra has and will continue to fight for this mission to increase safety on the road. Great job everyone!

Did you know that slips and falls account for over 1 million hospital visits and that according to the Consumer Product Safety Commission, floors and floor materials contribute directly to over 2 million fall injuries each year?

Recently attorneys Jennifer A. Neal, Attorney at Law and Oscar Quiroz, along with their team of Melissa Fuller, Kourtney Neutzler, and Amanda Reyes, were able to fight for our client who slipped and fell outside of a hotel on a painted sidewalk. They held the defendant accountable for failing to have proper safety precautions in place such as anti-slip protection in the paint, tape, or warning signs.

Jennifer and Oscar were able to settle the case so that our client could begin their road to recovery from their displaced fracture of their patella. The dedication and attention to detail that our team placed on this case ensured that our client would receive justice from the defendant. Great job, team!

This year over 48 million people will be hitting the road during Thanksgiving, according to Conde Nast. With the influx of people traveling, it is important to remember to drive with caution.

Recently attorneys Jorge Mares and Jennifer Neal (along with Kim Hays, Diane Garcia, and their team) settled an accident where an 18-wheeler made an unsafe lane change and crashed into our client. In order to bring justice to our client, our team worked diligently and efficiently to make sure that our client was taken care of. Way to go, team!
